Min CC 09/22/1998 V,w`r MINUTES OF CITY COUNCIL MEETING THE CITY COUNCIL OF CIBOLO CONDUCTED A REGULARLY SCHEDULED MEETING ON TUESDAY,SEPTEMBER 22,1998 AT 7:00 P.M.AT THE MUNICIPAL BUILDING,109 SOUTH MAIN STREET,CIBOLO,TEXAS.THE FOLLOWING WAS THE ORDER OF BUSINESS: I. CALL TO ORDER. Mayor Sam Bauder called the meeting to order at 11. ROLL CALL. Present were Mayor Bauder,and Council members Jeff Miller,Bob Glisar,Paul Buell,Chuck Ridge,and Gail Douglas. Staff was represented by City Attorney Ron Flake,City Administrator Tom Newman,and Code Compliance Officer Keith Gilbreath. III. INVOCATION. Bob Glisar provided the invocation. IV. PLEDGE OF ALLEGIANCE. Mayor Bauder led the pledge. V. CITIZENS TO BE HEARD. (LIMIT 3 MINUTES EACH) None. VI. CONSENSUS ITEMS: A. APPROVAL OF MINUTES OF SEPTEMEBR 14,1998 Jeff Miller.motioned to approve the minutes. Chuck Ridge seconded. Approved. VII. DISCUSSION/ACTION ON WOODS SUBDIVISION UNIT 2 FINAL PLAT Keith Gilbreath presented a final plat approved by P&Z. Paul Buell motioned to approve. Jeff Miller seconded. Approved. VIII. DISCUSSION/ACTION ON REQUEST FOR SETBACK VARIANCE FOR 101 BRUSH TRAIL BY JAPHET HOMES Keith Gilbreath presented the variance request approved by P&Z. Paul Buell motioned to approve. Bob Glisar seconded. Approved. IX. DISCUSSION/ACTION ON RESOLUTION FOR INTERLOCAL AGREEMENT WITH GUADALUPE COUNTY ON TRAFFIC REGULATION AND ENFORCEMENT Tom Newman presented an interlocal agreement resolution passed by the County to be amended in their next Court session. He also presented a City Resolution to participate in the agreement to set,post,and enforce traffic regulations on Dietz,Borgfeld,and Town Creek Roads. Bob Glisar motioned to approve the City Resolution. Paul Buell seconded. Approved. X. DISCUSSION/ACTION ON CITY ORDINANCE TO SET AND ENFORCE TRAFFIC REGULATION ON DIETZ,BORGFELD,AND TOWN CREEK COUNTY ROADS Tom Newman presented a City Ordinance to set,post,and enforce traffic regulation on Dietz,Borgfeld, and Town Creek Roads. Th e Ordinance defines speed limits,school zones,school crossings,parking restrictions,and a three-way stop at Dietz Rd.and Deer Meadow. Paul Buell motioned to approve the Ordinance. Jeff Miller seconded. Approved. XI. DISCUSSION/ACTION ON SEXUALLY ORIENTED BUSINESS ORDINANCE Ron Flake presented a City Ordinance to regulate adult entertainment businesses in the City of Cibolo, and explained the distances,purpose,and rationale. Bob Glisar motioned to approve the Ordinance. Chuck Ridge seconded. Approved. XII. COMMENTS BY STAFF Tom Newman submitted the attached Administrator's Report. Council members inquired as to the reasons we have difficulty filling the vacant personnel positions.Tom Newman explained the cancellations and no- shows during recruitment. Mayor Bauder expressed his desire to get both open positions filled as quickly as possible,and requested we keep track of reasons for not taking the job. Tom Newman informed that Green Valley had submitted a cost study that challenged the City's contract,calculated a water rate of $1.3870 per 1000 gallons as justifiable,and calculated a transport rate for water from the City well at $0.3178 per 1000 gallons. He also noted that Ed Ford had contacted SCADA and learned the cost of well system telemetry would be about$8500—less than originally forecasted. However,some questions about where we must connect need to be answered before we can determine an actual cost to open the well. Council requested an annual overall cost/savings report. He verified that certain cities had expressed clear interest in any EAA interim rights we cannot use. Mayor Bauder observed that he felt our first priority should be to open the well and use our water rights. Tom Newman also explained that certain definitions in our Subdivision Ordinance need to be clarified to ensure all developments receive proper approval by the City. He will meet with a P&Z subcommittee and Keith to clarify the definitions. Keith Gilbreath informed Council he was pricing both concrete and wolmanized lumber coverings for the proposed walkway between Dietz Rd.and Notchleaf. Park project is progressing,but will probably stop tomorrow as roof is being put on before the red iron is painted. Colors have been selected. Litigation process is ongoing. Inventory is being worked on. Park power is available to the old area,but not yet to the rest rooms. Mayor Bauder inquired regarding Thistle Creek Dr.but there has been no progress. It must be done before the Dietz Rd project starts. XIII. COMMENTS BY COUNCIL MEMBERS None XIV. COMMENTS BY MAYOR Mayor Bauder informed Council he would not be able to attend the 10/13/98 Council Meeting. XV.
