RESOLUTION NO.
A RESOLUTION BY THE CITY COUNCIL OF .THE CITY OF .CIBOLO, TEXAS
RELATING TO AMENDING THE PERSONNEL POLICY I TO INCLUDE THE
REGULATION OF THE SICK LEAVE POOL; PROVIDING. THAT THIS
RESOLUTION.7 SHALL BE CUMULATIVE OF ALL OTHER RESOLUTIONS;
PROVIDING FOR SEVERABILITY;. AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 4.06 of the Cibolo City Charter provides that the City Council shall, by
ordinance or resolution, establish personnel policies; and
WHEREAS, the City Council establishes a Sick Leave Pool for all employees who meet the
criteria to contribute to the Sick Leave Pool and apply to receive sick leave benefits from the
. .Sick Leave Pool in the event the employee experiences aweligible catastrophic event; and.
WHEREAS,the City.Council amends the personnel policy to establish the Sick Leave Pool .
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF.THE CITY
OF CIBOLO,TEXAS:,
SECTION 1
The meeting at which this resolution was approved was in all things conducted in compliance
with the Texas Open Meetings Act, Texas Government Code, Chapter.'551.
SECTION 2
The City of Cibolo Personnel Policies is amended by adding the following:
Policy 1.4 Leave Benefits
1.4.10 Sick Leave Pool
The City of Cibolo may establish a Sick Leave Pool which may provide a source of
additional paid Leave to an Employee if a catastrophic illness or injury forces an Employee
to exhaust all earned:Leave and go into anon-pay status.
Eli ibili : Employees can be eligible for the program by choosing to donate a minimum of 8
hours to a maximum of 80 hours of their accrued sick leave annually. This requirement is
reoccurring, requiring employees to donate every year to be eligible for the:Sick Leave Pool.
Application Requirements: An employee Wanting to submit an application to receive sick
-leave benefits from the Sick Leave Pool must meet the following requirements:
• The employee must be out of work for a minimum of(30) calendar days due-to a
catastrophic illness or injury;
• The employee may not have any accrued paid leave available, including time accrued
while participating in the.sick leave pool;
• The employee must be a regular, full-time employee who has been continuously
employed with the City.for at least twelve (12) months;
• The employee's catastrophic illness or injury may not be a result of activity that is in
the course of employment with the City;
• The employee must not be receiving Worker's Compensation.benefits;
• The employee must be on approved FMLA status;
• The employee must turn in a completed application to Human Resources.
Review/Approval Process: When an application for the Sick Leave Pool is received by
Human Resources,the Sick Leave Pool Committee will review,the application to determine.
approval or denial on a case-by-case basis based on the criteria of the policy. The Sick Leave
Pool Committee will be comprised of Department Heads,to.include: .
• City Manager
• City Secretary
Human Resources Director
• Finance Director
• Planning Director
• ' IT Director
• Police Chief
• Fire Chief
• Public Works Director
The City Manager makes the final decision on all Sick Pool applications. Sick Leave is not
guaranteed.
SECTION 3
CUMULATIVE CLAUSE
The Amendment outlined in Section 2 o the City of.Cibolo.Personnel Policies, are the only
changes and the remainder of the,Policy.shall stay as written.. That this Resolution shall.be
cumulative of all other ordinances and resolutions of the City of Cibolo, Texas,except where
the provisions of this Resolution are in direct conflict with the provisions of such other
ordinances and/or resolutions, in which event the conflicting provisions of-such ordinances or
resolutions are hereby repealed.
SECTION 4
SEVERABILITY
That it is hereby declared to be the intention of the City Council of the City of Cibolo that the
phrases;clauses, sentences, paragraphs, and sections of this Resolution .are severable, and if
any..phrase, clause, sentence, paragraph or section of this Resolution should.be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction;such
unconstitutionality shall not affect any of the remaining phrases, clauses, sentences;
paragraphs or sections of the Resolution s, since the_same would have:been enacted by the
City Council without incorporation in this resolution of,any such:unconstitutional phrases,
clause, sentence,paragraph or section. .
SECTION 5
EFFECTIVE DATE
This Resolution shall take effect.and shall be in full force upon adoption.
PASSED AND APPROVED AND ADOPTED THIS 7 DAY OF MAY 2022.
