Min CC 10/21/2004 - Special CITY COUNCIL SPECIAL MEETING -4k CIBOLO MUNICIPAL BUILDING 109 S.MAIN October 21,2004 6:00 P.M. MINUTES 1. Call to Order—Mayor Ruppert called the meeting to order at 6:02 P.M. 2. Roll Call—All members of council were present with the exception of Councilwoman Hartman. 3. Executive Session: Pursuant to LGC Section 551.071,Consultation with Attorney and Pending and contemplated Litigation to discus the following: A. Discussion on TWC's denial of Keith Gilbreath's application for unemployment benefits,his current appeal, and his complaint. B. Discussion on the City of Santa Clara incorporation of portions of the City of Cibolo ETJ without the approval of the City of Cibolo;possible remedies including litigation and City of Santa Clara versus City of Cibolo, Cause No 04-1715-CV. C. Discussion of the demand for retainage by ELLA Contracting on the sewer line contract; disputed claims and negotiations. Council went into session at 6:04 P.M. 4. Open Session Council reconvened in open session at 7:25 P.M. A. Discussion/Action on TWC's denial of Keith Gilbreath's application for unemployment benefits,his current appeal,and his complaint. Councilman Campbell made the motion to direct City Attorney to continue to monitor situation and act as needed, seconded by Councilman Sutton. For: All,Against: None. B. Discussion/Action on the City of Santa Clara incorporation of portions of the City of Cibolo ETJ without the approval of the City of Cibolo;possible remedies including litigation and City of Santa Clara versus City of Cibolo, Cause No 04- 1715-CV. Councilman Sutton made the motion to direct City Attorney to answer the suit and prepare a countersuit, seconded by Councilman Campbell. For: All,Against: None. C. Discussion/Action on the demand for retainage by ELLA Contracting on the sewer line contract; disputed claims and negotiations. Councilman Sutton made the motion to direct City Attorney to proceed as advised to council with the coordination from Rudy Klein,seconded by Councilwoman Hartman. For:All,Against: None. 5. Comments A. City Staff—Todd Parton stated that he had a received the Final Master Plan, so council could get theirs for review. B. City Council—Councilman Sutton briefed Council that CRWA is now involved in another law suit. C.Mayor—None. 6. Adjournment Councilman Campbell made the motion to adjourn at 7:33P.M., seconded by Councilwoman Hartman. For:All, Against: None. PASSED AND APPROVED THIS 26TH DAY OF OCTOBER 2004.
