Call to Order—Meeting was called to order by Mayor Boyle at 6:30 p.m. 2. Roll Call and Excused Absences — Council Present: Mayor Boyle, Councilwoman Schultes, Councilman Bone, Councilman Gibbs, Councilman Allen, Councilman Woliver and Councilman Hicks. Members Absent: Councilman Quinn. Councilman Hicks made the motion to approve the absence of Councilman Quinn. Motion was seconded by Councilman Allen. For: All; Against: None. Motion carried 6 to 0. 3. Invocation—Invocation was given by Councilman Hicks. 4. Pledge of Allegiance—All in attendance recited the Pledge of Allegiance. 5. Public Hearing A. The Cibolo City Council will hold a public hearing to hear public testimony regarding the acceptance of an application of voluntary annexation of approximately 10 acres located southeast of the intersection of Tolle Road and Weil Road. PULLED BY APPLICANT B. The Cibolo City Council will hold a public hearing to hear public testimony regarding the assignment of permanent zoning of approximately 9 acres of Multi-Family (MF-1) and approximately 1 acre of Community Retail/Service (C-2) district located southeast of the intersection of Tolle Road and Weil Road, that may be annexed into the City of Cibolo. PULLED BY APPLICANT C. The Cibolo City Council will hold a public hearing to hear public testimony regarding an amendment to the Unified Development Code Article 4.5.3 and Article 13-Use Tables to create two new non- residential restrictive alcohol sales districts "C2-R" and "0-R," identical to "C-2 Community Retail/Service and "C3 General/Retail Office" zoning districts, except that establishments deriving 75 percent or more of the establishment's gross revenue from the on-premise sale of alcoholic beverages will be prohibited. This item was briefed by Mr. Klein. Mayor Boyle open the public hearing at 6:36 p.m. No one wish to speak, and Mayor Boyle closed the public hearing at 6:36 p.m. D. The Cibolo City Council will hold a public hearing to hear public testimony regarding an amendment to Article 13-Use Tables of the Unified Development Code to modify the prohibited use of a Community Residential Facility in Single Family Residential districts, to a Conditional Use Permit. Mr. Klein briefed this item to the City Council. Mayor Boyle open the public hearing at 6:40 p.m. The following individuals spoke: Sergio Mercado opposed the change to the UDC. He stated he represented 750 people in Turning Stone, Mesa at Turning Stone and Saratoga that all opposed the amendment to the UDC. James Hendrix a member of the HOA Board spoke in opposition of this change to the UDC. Mr. Hendrix also stated that all individuals that buy a home in Turning Stone signs a contract that the use of this property would not be used for anything other than a private residence and prohibits lots for use as a business other than a home office. Mr. Hendrix also want to know if this would affect the fire code. Shane Merillot also opposed the change to the UDC as all individuals are aware of the deed restrictions when they purchase their homes. Safety and noise would also be a concern. 6. Citizens to be Heard This is the only time during the Council Meeting that a citizen can address the City Council. It is the opportunity for visitors and guests to address the City Council on any issue to include agenda items. All visitors wishing to speak must fill out the Sign-In Roster prior to the start of the meeting. City Council may not debate any non-agenda issue, nor may any action be taken on any non-agenda issue at this time; however, City Council may present any factual response to items brought up by citizens. (Attorney General Opinion—JC-0169) (Limit of three minutes each.) All remarks shall be addressed to the Council as a body, and not to any individual member thereof. Public criticism of the City Council or any action, policy program or service provided by the City is not prohibited. However, any person making personal, impertinent, or slanderous remarks to individual members of the Council while addressing the Council may be requested to leave the meeting. The following individuals signed up to be heard: The City Secretary read an email sent in by Amanda Ashcroft. Ms. Ashcroft wanted to inform the council that TX Community Watershed Partners a program of TX A&M is bringing a virtual, no-cost, FEMA Workshop to Guadalupe County on March 3`d and 4th from 8-11 a.m. She invites everyone to register for the event. Maggie Titterington thanks Ms. Lee for speaking with the Leadership Core. Robert Roberson thank everyone especially the Cibolo Fire Department when they had to come to his house for an emergency medical situation. Mr. Roberson stated the GVSUD would be having a Public Forum on January 19th at 7:00 p.m. and he hopes that the citizens would come out and ask questions. Kara Latimer would like to have council look at removing the S175 and SF 6 zoning districts from the Unified Development Code (UDC). 7. Consent Agenda—Consent Items (General Items) (All items listed below are routine and non-controversial by the council and will be approved by one motion. There will be no separate discussion of these items unless a Council member so requests, in which case the item will be removed from the consent agenda and will be considered as part of the order of business.) A. Approval of the minutes of the regular City Council Meeting held on December 10, 2020. B. Approval and authorization for the City Manager to execute the Texas Volkswagen Environmental Mitigation grant with the Texas Commission of Environmental Quality Air Grants Division for the replacement of two dump trucks. Motion was made by Councilman Hicks to approve the consent agenda. Motion was seconded by Councilman Woliver. For: All; Against: None. Motion carried 6 to 0. 2 8. Staff Update A. Police Department—Reports for December 2020. E. IT Department F. Administration—Update on COVID-19 As presented in councils' packet. 9. Discussion/Action A. Discussion/Action on COVID-19 to include Antimicrobial Disinfecting and Sanitizing and an extension of the Administrative Directive on FLMA Leave Expansion and Emergency Paid Sick Leave to cover leave between January 1, 2021 and March 31, 2021 without extending the amount of leave available to each employee. Councilman Gibbs made the motion to approve the amended Economic Development Agreement but not to have the Agreement executed until the exhibits have been reviewed by Council. Motion was seconded by Councilman Woliver. For: All; Against: None. Motion carried 6 to 0. C. Discussion from Councilmembers that have attended seminars, events or meetings for the City of Cibolo. Councilman Hicks stated that he had attended virtue AAMPO Meeting and virtue County Judge Meetings. Councilman Allen stated he attended the ribbon cutting at Magnolia Pancake Haus. D. Discussion on items council would like to see on future agendas. Mayor Boyle would like a discussion/Action item on SF5 & SF6 removal from the UDC as mentioned by the Planning & Zoning Commission. Councilman Hicks would like an update on the road projects especially Cibolo Valley Drive. Councilman Gibbs would also like to see the road projects, but he stated updating the chart and sending it out to council would be acceptable. E. Discussion/Action on the review and confirmation of all upcoming special meetings and workshops and scheduling the time, date and place of additional special meetings or workshops. Council went over the calendars for January and February 2021. 3 10. Ordinances A. Councilman Woliver made the motion to approve the Resolution of the City of Cibolo authorizing the award of a professional service provider contract for the 2021-2022 Texas Community Development Block Grant Community Development Fund.
