Min CC 12/06/2005 - Special SPECIAL CITY COUNCIL MEETING CIBOLO MUNICIPAL BUILDING 200 S.MAIN December 6,2005 7:00 P.M. NIINUTES 1. Call to Order—Mayor Sutton called the meeting to order at 7:02 P.M. 2. Roll Call— Councilwoman Hartman Councilman Kelly Councilman Ramcharan was absent Councilman Campbell Councilman Troncoso 3. Discussion/Action A. Discussion/Action regarding a formal purchasing policy that provides guidelines for the expenditure of City funds. City Manager Todd Parton presented a presentation to council on the purchasing policy and guidelines. ":. Ordinance A. Discussion/Action regarding the adoption of an ordinance to establish a formal purchasing policy that provides guidelines for the expenditure of City funds. Councilman Troncoso moved to approve the Purchasing Policy and Guideline Ordinance. Seconded by Councilman Kelly. For: All,Against: None. 5. Executive Session: The City Council will meet in Executive Session under Texas Local Government Code Sec. 551.071 Pending and Contemplated Litigation to consult with the City Attorney and discuss the following: A. Discussion regarding the settlement in the case styled The City of Santa Clara, Texas V. The City of Cibolo, Texas,Cause No.04-1715-CV,in the 25`h Judicial District Court of Guadalupe County,Texas B. Discussion regarding engaging outside counsel to review and present to City Council an opinion on the Council's legal options and legal obligations under the City of Cibolo Home Rule Charter and Texas state law regarding the recall petition election. Council convened into executive session at 6:40 P.M. 6. Open Session A. Reconvene into Open Session to take appropriate action and to give staff direction, if necessary, on any of the items discussed in Executive Session. Council reconvened into open session at 7:20 P.M. Councilman Campbell moved to approve the settlement agreement with the City of Santa Clara and authorize the mayor to sign the agreement. Seconded by Councilman Kelly. For: All, Against: None. Councilman Kelly moved to approve engaging outside counsel to review and present to City Council an opinion on the Council's legal options and legal obligations under the City of Cibolo Home Rule Charter and Texas State Law regarding the recall petition election. Seconded by Councilman Troncoso. For: All,Against: None. 7. Adjournment Councilman Campbell moved to adjourn at 7:24 P.M. Seconded by Councilman Kelly. For: All,Against: None.
