Min CC 03/30/2020 - Special Meeting o F Cl& °' r==o rex �s "City of Choice" SPECIAL CITY COUNCIL MEETING CIBOLO MUNICIPAL BUILDING 200 S.Main March 30,2020 6:30 p.m. CITY COUNCIL OF THE CITY OF CIBOLO WILL BE HELD BY VIDEO CONFERENCE TO CONSIDER AND ACT UPON ANY LAWFUL SUBJECT WHICH MAY COME BEFORE SAID MEETING,INCLUDING, AMONG OTHERS,THE ITEMS LISTED ON THE AGENDA. INSTRUCTIONS FOR VIDEO-CONFERENCE THIS COUNCIL MEETING WILL BE HELD USING A VIDEO CONFERENCE SYSTEM CALLED ZOOM AND IS AUTHORIZED BY GOVERNOR GREG ABBOTT'S TEMPORARY SUSPENSION OF CERTAIN ASPECTS OF THE TEXAS OPEN MEETINGS ACT WHICH ALLOWS FOR A GOVERNING BODY TO HOLD A "VIRTUAL" MEETING SO AS TO AVOID GATHERING MEMBERS OF THE PUBLIC AND/OR BOARD MEMBERS IN A PHYSICAL SETTING THAT MIGHT CONSTITUTE A PUBLIC HEALTH RISK. Call to Order—Meeting was called to order by Mayor Boyle at 6:35 pm. 2. Roll Call—Members Present: Mayor Boyle,Council Members: Schultes,Quinn,Bone,Gibbs,Allen,Woliver, and Hicks; Staff Present: City Manager Mr.Herrera,City Attorney Mr. Garza, City Secretary Ms. Cimics and IT Director Mr. McDaniel. 3. Citizens to be Heard PUBLIC COMMENTS ARE TO BE SUBMITTED IN WRITING TO CITY SECRETARY for the City Council meeting,public comment/input may be provided,in writing,in the form of an e-mail and shall be e- mailed to the City Secretary at pcimics@cibolotz.gov no later than 30 Minutes prior to the start of the meeting.This is the only time during the Council Meeting that a citizen can address the City Council. It is the opportunity for visitors and guests to address the City Council on any issue to include agenda items.All visitors wishing to speak must fill out the Sign-In Roster prior to the start of the meeting. City Council may not debate any non-agenda issue,nor may any action be taken on any non-agenda issue at this time;however,City Council may present any factual response to items brought up by citizens. (Attorney General Opinion—JC-0169)(Limit of three minutes each.)All remarks shall be addressed to the Council as a body,and not to any individual member thereof. Public criticism of the City Council or any action,policy program or service provided by the City is not prohibited. However, any person making personal, impertinent,or slanderous remarks to individual members of the Council while addressing the Council may be requested to leave the meeting. Councilman Quinn read an email from Cindy Spencer asking that City Leader step up and close the City Parks. People are still continuing to hang out at the parks. Water fountains left open are just a great place for people to spread this virus as it lives on stainless steel for 4 days. Ms. Spencer stated that she did a poll and 32 people voted (30 said yes close the parks and only 2 voted no). Although it was a small amount of people voting it showed the majority wanted them closed. Councilman Quinn also read an email sent in from Jayme Mathis. Jayme Mathis felt that council should stay united with Guadalupe County and Governor Abbott and follow their lead. He did not feel Cibolo should go above and beyond what they suggest. Councilwoman Schultes read an email sent in from Jason Wiederstein. He urged council not to issue any more unconstitutional mandates for our citizens. Councilman Hicks read an email from Cassandra Kearns asking council not to close businesses in Cibolo. She said it would be detrimental to small business and the big business survive. The City Secretary read the emails from the following individuals: Ralph Himelrick wrote that it would be in the best interest of the City that they close all parks including HOA parks. Bruce Winter also want the parks closed to include HOA parks. Melvin Hicks thank the City Council, City Staff,and City Manager for all the time they have spent during the COVID-19. Lisa Jackson urged the Mayor and Council to put into place a mandatory Stay at Home declaration for our city for at least another 14 days,but preferably to match the President of the United States of April 30, 2020. She also asks them to consider covering the playscapes that are owned by the city. Randall Hawkins also ask council to consider closing all parks to include HOA parks. 4. Discussion/Action on the Mayoral Declaration of Local State of Disaster due to Public Health Emergency. Councilman Hicks made the motion to ratified the Mayoral Declaration of Local State of Disaster due to Public Health Emergency. Motion was seconded by Councilman Quinn. For: All;Against:None. Motion carried 7 to 0. City Council than discussed the Declaration in detail. Councilman Gibbs made the motion to include in the Declaration to close all public and private parks with the exception of walking trails and green space in the City of Cibolo. Councilman Hicks seconded the motion but amended the motion to include no solicitation. Councilman Gibbs approved with the change of the motion. For: Councilwoman Schultes—No,Councilman Quinn—No, Councilman Bone—Yes, Councilman Gibbs—Yes, Councilman Woliver—No,Councilman Allen—Yes,and Councilman Hicks—Yes. Motion carried 4 to 3. 5. Adjournment Councilman Hicks made the motion to adjourned the meeting at 7:50 pm. Motion was seconded by Councilwoman Schultes. For:All;Against:None. Motion carried 7 to 0.
