Min CC 05/15/2006 - Special SPECIAL CITY COUNCIL MEETING CIBOLO MUNICIPAL BUILDING 200 S.MAIN May 15,2006 7:00 P.M. rvM _UTES 1. Call to Order—Mayor Sutton called the meeting to order at 7:02 P.M. 2. Roll Call Councilwoman Hartman Councilman Kelly Councilman Ramcharan Councilman Campbell-absent Councilman Troncoso-absent 3. Invocation Mayor Sutton gave the invocation 4. Pledize of Alleiziance Councilman Kelly led the Pledge of Allegiance 5. Citizens to be Heard—This is the opportunity for visitors and guests to address the City Council on any issue. City Council may not debate any non-agenda issue, nor may any action be taken on any non-agenda issue at this time however City Council may present any factual response to items brought up by citizens. (Attorney General Opinion— JC-0169)(limit of three minutes each). Tony Krasnai,2922 Green Valley Road,spoke on the flooding at Cove Lane and Green Valley Road. 6. Discussion/Action(General) A.Discussion/Action on the update to the Sexually Oriented Business Ordinance. Susan Roche, City Attorney gave the council a brief overview of the ordinance. B. Discussion/Action to approve a budget amendment to the FY 2005-2006 budget for emergency repairs. Todd Parton,City Manager briefed Council on an amendment to the current budget due to the emergency repairs required by the major water line break. Councilman Kelly moved to approve the budget amendment due to emergency repairs and the motion was seconded by Councilwoman Hartman. For: All,Against: None. 7. Resolution A. Approval/Disapproval of a resolution establishing the Legislative finding of the City Council of the City of Cibolo regarding adverse secondary effects of sexually oriented businesses on the community based on the presentation and review of reports and studies demonstrating the negative effects of these businesses and the case law that confirms the authority of a city council to adopted regulations for sexually oriented businesses in their community. Councilman Kelly moved to approve the resolution establishing the Legislative findings of the City Council of the City of Cibolo and the motion was seconded by Councilwoman Hartman. For: All,Against: None. 8. Ordinances A. Approval/Disapproval regarding an ordinance repealing ordinance 498 and.adopting a new ordinance entitled "Sexually Oriented Business Regulations"; providing for classification of a sexually oriented business;providing for application and license requirements for a sexually oriented business and employees of the business; providing for location of a sexually oriented business; providing for exemptions, enforcement and penalties; and providing for publication and an effective date. Councilman Kelly moved to approve the ordinance repealing ordinance 498 and adopting a new ordinance entitled Sexually Oriented Business Regulations. Motion was seconded by Councilwoman Hartman. For: All, Against: None B. Approval/Disapproval of an ordinance to amend the budget for the fiscal year 2005-2006. Councilman Kelly moved to approve the ordinance to amend the fiscal year 2005-2006 fiscal year budget. Motion was seconded by Councilman Ramcharan. For: All,Against: None. 9. Executive Session Pursuant to Tex. Government Code Sec 551.071 Attorney Client Consultation and 551.074 Personnel Matters, the City Council will meet in Executive Session to discuss the following: Discussion regarding the evaluation of the City Manager. Council convened into Executive Session at 7:25 P.M. 10. Open Session Reconvene into Regular Session and take action/or give staff direction, if necessary, on items discussed in Executive Session. Council reconvened into Regular Session at 8:05 P.M. 11. Staff Updates A.Review of upcoming special meetings and workshops. B. City Council requests regarding specific items or staff reports to be scheduled for future agendas. Todd Parton briefed council on the above items. Mayor Sutton requested that the canvassing of the election be put on the agenda for the May 23 Coum^il Meeting. 12. Adjournment Councilman Ramcharan moved to adjourn the meeting at 8:09 P.M.
