Call to Order — Meeting was called to order by Mayor Boyle at 6:3 0 p.m. 2. Roll Call and Excused Absences — Members Present: Mayor Boyle, Councilwoman Schultes, Councilman Garrett, Councilman Byrd, Councilman Gibbs, Councilman Woliver, Councilman Hicks and Councilman Allen (arrived at 6:35 p.m.). Staff Present: City Manager Mr. Herrera, City Attorney Mr. Lindner, City Secretary Ms. Cimics, Finance Director Ms. Miranda, IT Director Mr. McDaniel, Police Chief Hugghins, Fire Chief Troncoso, Planning & Engineering Director Mr. Klein, EDC Director Mr. Luft and Public Works Director Mr. Fousse. 3. Invocation — Invocation was given by Councilman Woliver. 4. Pledge of Allegiance — All in attendance recited the Pledge of Allegiance. 5. Citizens to be Heard This is the only time during the Council Meeting that a citizen can address the City Council. It is the opportunity for visitors and guests to address the City Council on any issue to include agenda items. All visitors wishing to speak must fill out the Sign -In Roster prior to the start of the meeting. City Council may not debate any non - agenda issue, nor may any action be taken on any non -agenda issue at this time, however, City Council may present any factual response to items brought up by citizens. (Attorney General Opinion — JC -0169) (Limit of three minutes each.) All remarks shall be addressed to the Council as a body, and not to any individual member thereof. Public criticism of the City Council or any action, policy program or service provided by the City is not prohibited. However, any person making personal, impertinent, or slanderous remarks to individual members of the Council while addressing the Council may be requested to leave the meeting. The following individuals spoke at Citizens to be Heard: Kevin Raynor spoke on Cibolofest and thanked the Police and Fire Department for all they do. David Strauss congratulated the City of Cibolo for Project Sea Horse. He is running for a place on the Green Valley SUD ballot and hopes to work together with everyone. Cindy Spencer stated that it seems that we no longer have rules or we don't follow them. Some people get attack if you say something about someone but others can call your name out and nothing is said. She also spoke on HB 2840 which gives the right for citizens to speak on an item before a vote. Glenn Weber spoke on the Summer Night's Program. He questioned on how it is run and who runs the program. He said he sees no minutes, has no idea who the members are or where they meet. Lisa Jackson also spoke on the Summer Night's Program and stated that when she went to the website it directed you to a place in Los Angeles and she is concerned about this. She thanked Councilman Gibbs for the second proclamation for Domestic Violence. Ms. Jackson also spoke on the Toll Road. She made the comment that we need this road and with AW Texas bring 2000 jobs that means more vehicles. She hopes that the City Council is not slowing down this project and hopes that we are honoring the contract that council signed. Tricia Dona of KJMS thanked the city for letting them be part of Cibolofest. She also stated that they will be offering a free class on October 26 from 10 to 12 and all donations will be donated to Breast Cancer for Breast Cancer Awareness Month. James Guyett stated that some people don't have a voice because if they speak out they are attack. He stated that his wife was attack just because she went on Facebook to gain information on the candidates and events. Council needs to follow the charter and speak with one voice when a decision has been made. The Mayor called on Melvin Hicks but was waved off indicating to the Mayor that he did not wish to speak. 6. Consent Agenda — Consent Items (General Items) (All items listed below are considered to be routine and non -controversial by the council and will be approved by one motion. There will be no separate discussion of these items unless a Council member so requests, in which case the item will be removed from the consent agenda and will be considered as part of the order of business.) A. Approval of the minutes of the Regular City Council Meeting held on October 8, 2019. B. Approval of the August 2019 Check Register pending final acceptance of the City's financial audit for the 2018/2019 fiscal year. C. Approval of the August 2018 Revenue and Expense Report pending the final acceptance of the City's financial audit for the 2018/2019 fiscal year. The Mayor read the above item but before any action took place Councilman Hicks stated that Melvin Hicks did not receive his time to speak. The Mayor stated that Melvin Hicks had waived him off indicating he did not wish to speak. Melvin Hicks walked up to the podium and started speaking. He stated that anything I say will be criticized and my family has already suffered enough. Councilwoman Schultes also stated that she would like to speak and thanked the police and fine department on a call they made to her house early in the morning. Mayor Boyle continued with the consent agenda. Councilman Woliver made the motion to approve the consent agenda. Motion was seconded by Councilman Byrd. For: All; Against: None. Motion carried 7 to 0. Staff Updates/Discussion A. Public Works B. Court C. Police Department — Chief Hugglums briefed the council on events the Police Department will be having in the next couple months. D. Administration 8. Discussion/Action A. Discussion from Councilmembers that have attended seminars or meetings for the City of Cibolo. Council had no items to report. B. Discussion on items council would like to see on future agendas. Councilman Allen requested an update of Cibolo Valley Drive. C. Discussion/Action on the review and confirmation of all upcoming special meetings and workshops and scheduling the time, date and place of additional special meetings or workshops. Council went over the calendars for October and November 2019. D. Discussion and direction to staff concerning an amendment to Chapter 74 Traffic and Vehicles, of the Code of Ordinances, by adding Article III Transportation of Septic Sludge. This item was discussed by council and no additional changes were noted. Council would like to see this brought back to the next agenda to be adopted. 9. Ordinances A. Approval/Disapproval of an Ordinance of the City of Cibolo enacting regulations with regards to regulating the activities of commercial trucks in the City of Cibolo. Councilman Gibbs made the motion to approve the Ordinance of the City of Cibolo enacting regulations with regards to regulating the activities of commercial trucks in the City of Cibolo and adding Green Valley Road in the City limits to the list of streets designated as "No Through Truck Traffic' streets. Motion was seconded by Councilman Hicks. For: All; Against: None. Motion carried 7 to 0. 10. Adjournment Councilman Garrett made the motion to adjourn the meeting at 7:21 p.m. Motion was seconded by Councilman Hicks. For: Council Members: Schultes, Garrett, Gibbs, Allen, Woliver and Hicks; Against: Councilman Byrd. Motion carried 6 to 1. PASSED AND APPROVED THIS 12TH DAY OF NOVEMBER 2019.
