ORD 1263 04/23/2019ORDINANCE NO. 1263 AN ORDINANCE AMENDING THE CITY OF CIBOLO'S CODE OF ORDINANCES CHAPTER 2, ARTICLE IV BOARDS AND COMMISSIONS; PROVIDING FOR THE COURT SECURITY COMMITTEE; PROVIDING FOR ADOPTION; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE OF ALL OTHER ORDINANCES OF THE CITY OF CIBOLO NOT IN CONFLICT WITH THE PROVISIONS OF THIS ORDINANCE; PROVIDING FOR SEVERABILITY; PROVIDING SAVINGS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The City of Cibolo is a home rule municipality given broad discretionary powers under the Texas Constitution to regulate for the public health, safety and general welfare of its citizens; and WHEREAS, Sec. 29.014 of the Texas Government Code mandates that a municipal judge shall establish a court security committee; and WHEREAS, the City Council of the City of Cibolo desires to create a committee to be known as the Cibolo Court Security Committee. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: SECTION 1. CIBOLO COURT SECURITY COMMITTEE CREATED SECTION 1.1 CREATION, COMPOSITION AND APPOINTMENT OF MEMBERS There is hereby created a committee of the City Council of the City of Cibolo, Texas which shall be known as the Cibolo Court Security Committee. The Committee shall consist of six (6) members composed of the presiding judge, the Senior Court Clerk, a representative of the City Secretary's office, two representatives of the law enforcement agency or other entity that provides the primary security for the court and one citizen of Cibolo. SECTION 1.2 QUALIFICATIONS AND TERMS OF MEMBERS All members of the Committee shall within one month of their appointment complete the Open Meeting and Public Information Video. In February of each year they shall attend one of the two mandatory sessions given on Ethics Training. Failure to comply with the requirements will be cause for dismissal from the committee. 1 SECTION 1.3 DUTIES OF THE CIBOLO COURT SECURITY COMMITTEE The purpose of the Cibolo Court Security Committee shall be to establish the policies and procedures necessary to provide adequate security to the municipal courts served by the municipal judge, as applicable. The committee may recommend to the municipality the uses of resources and expenditures of money for courthouse security, but may not direct the assignment of those resources or the expenditure of those funds. SECTION 1.4 ORGANIZATION AND MEETINGS The members of the Cibolo Court Security Committee shall hold a regular meeting no less than three times a year. The committee will conduct its meetings in conformance to rules established by the City Council as authorized by Section 3.12 of the City Charter. The following describes the Officers and their duties: Chairman: (1) Shall be the municipal judge for the City of Cibolo. (2) Shall preside over all Committee meetings and have the right to vote. (3) Shall represent the Committee to the City Council. All meetings shall be open to the public and minutes shall be kept, and shall be treated as a public record. All meetings shall be held in full compliance with the provisions of the Texas Open Meetings Act and applicable city ordinances. SECTION 1.5 QUORUM Three (3) Committee members shall constitute a Quorum for the transaction of business. A meeting may be canceled for lack of a quorum after a 15 -minute period has elapsed from the scheduled time of the start of the meeting. A meeting may also be canceled in advance if absence notifications received by the City Secretary provide for lack of a quorum. SECTION 1.6 RULES AND PROCEDURES; RECORD OF PROCEEDINGS The Cibolo Court Security Committee will follow the Rules and Procedures as provided in the City Council Policy. The City Secretary or her designated representative shall take minutes, record each session and post agendas as required. SECTION 1.7 COMPENSATION The Cibolo Court Security Committee shall serve without compensation. II. Severability If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and; 2 Repeal All ordinances or parts of ordinances in conflict with any of the provisions of this ordinance are hereby repealed insofar as the same is in conflict with the provisions hereof; and EFFECTIVE DATE This Ordinance shall be effective immediately upon the passage and approval of the City Council of the City of Cibolo, Texas, and it is so ordained.
