RES 1230 8/13/2002 RESOLUTION NO J�� A RESOLUTION AUTHORIZING AND DIRECTING THE COOPERATION OF THE CITY EMPLOYEES OF THE CITY OF CIBOLO AND ITS DULY APPOINTED OFFICIALS TO ENTER INTO A REGIONAL AGREEMENT TO OPERATE ON THE 800 MHz EDACS TRUNKING COMMUNICATIONS SYSTEM PROVIDED BY THE CITY OF LIVE OAK, TEXAS TO AID IN THE INTEROPERABILITY OF COMMUNICATIONS AMONG ITS NEIGHBORING MUTUAL AID MUNICIPALITIES AND SCHOOL DISTRICTS WITHIN THOSE MUNICIPALITIES. WHEREAS, the Cities of Converse, Selma, Universal City, Schertz, Cibolo, Windcrest, Kirby, Alamo Heights, Garden Ridge, San Antonio and Live Oak are municipal corporations and Judson Independent School District, Schertz-Cibolo School District, Bexar County Alamo Area Narcotics Task Force, Metro-Com Emergency Response Team, VIA-Metropolitan Transit and Combined Emergency Services Organization are found to be adjacent to each other and so closely interrelated unto each other as to be contiguous or have other mutual interests, and WHEREAS, defined by the 2001 National Public Safety Wireless Interoperability Forum; "Interoperability is the ability of public safety personnel to communicate by radio with staff from other agencies, on demand and in real time.", and WHEREAS, The National Public Safety Planning Advisory Committee of Region 53 in San Antonio Bexar County, Texas stated the purpose of the 800-Megahertz Frequency Band Plan as stated: "Public safety communications has, for many years, been inadequate throughout the United States." "Many, if not all, public safety radio users are constantly bombarded with outside interference, noise and over crowding." " It is with these problems in mind that this plan was developed.", and WHEREAS, The National Public Safety Planning Advisory Committee of Region 53 has approved application and purpose of the Live Oak 800 MHz EDACS Trunked Radio System for a five year slow growth of loading capacity of ten trunked channels to handle 1,000 radio users and five mutual aid channels for interoperability and clear channel communications for this area and all of Bexar County via mutual aid channels, and WHEREAS, The Live Oak 800 MHz EDACS Trunked System Infrastructure has the capacity to handle the metro-corn area of communication operation and capacity; while allowing current independent operations of dispatching remotely from the various cities and school districts, and WHEREAS, it is to their mutual interest that they assist each other in cases of emergency, or other cases where it is to their common benefit to, but not limited to, suppress criminal activity, suppress fire, Emergency Medical Service, evacuate people and/or other city, county or school district functions where interoperability of communications are required, and WHEREAS, it is to their mutual interest to correct deficiencies of the past, where there have been events within these cities and other cities across the nation, such as the events of, but not limited to, plane crashes, bombings, fires, terrorist activities, hostage situations, flooding, chemical spills and weather related events where mutual aid and interoperability of communications is a requirement, and WHEREAS, it is to their mutual interest in events requiring evacuation of civilians that school buses and VIA-Metropolitan Transit have the capability to utilize the interoperability provided by the Live Oak 800 MHz EDACS Trunked System to facilitate coordination between the event command post and the evacuation operations, and WHEREAS, it is to their mutual interest to utilize the Live Oak 800 MHz EDACS Trunked System which is compatible with Bexar County, the City of San Antonio and VIA- Metropolitan Transit, 800 MHz EDACS Trunked Systems, which are linked by mutual aid channels to enhance its capabilities of interoperability within this region of operation; NOW, BE IT THEREFORE RESOLVED that the City Manager of the City of Cibolo and its duly appointed officials and staff are hereby authorized and empowered to cooperate with and assist the employees and officials of the Cities Converse, Selma, Universal City, Schertz, Cibolo, Windcrest, Kirby, Alamo Heights, Garden Ridge, San Antonio, and Live Oak, Bexar County Judson Independent School District, Schertz-Cibolo Independent School District, Alamo Area Narcotics Task Force, Metro-Com Emergency Response Team, VIA Metropolitan Transit and Combined Emergency Services Organization, at such time and under such circumstances as the City Manager of Live Oak may deem appropriate. In making it's 10 channel 800 MHz EDACS Frequencies available for use and intercommunications by such governmental agencies. This resolution, however, is not to be construed as the creation of a binding contract but is intended primarily to implement and continue the mutual cooperation and assistance previously extended by the above mentioned cities, county and school districts to each other.
