RES 1313 08/16/2005 RESOLUTION #1313 RESOLUTION NO. J 05 A RESOLUTION RECOGNIZING THE INTENTIONS OF THE COMMISSIONERS COURT OF GUADALUPE COUNTY, TEXAS, AND THE CITY COUNCIL OF THE CITY OF CIBOLO, GUADALUPE COUNTY, TEXAS, FOR CERTAIN IMPROVEMENTS TO DIETZ ROAD BY GUADALUPE COUNTY AND THE ANNEXATION OF THE DIETZ ROAD RIGHT-OF-WAY BY THE CITY OF CIBOLO; PROVIDING FOR A TIME PERIOD TO INITIATE THE ANNEXATION OF THE DIETZ ROAD RIGHT-OF-WAY BY THE CITY OF CIBOLO. WHEREAS, a portion of the right-of-way for Dietz Road is located within the extraterritorial jurisdiction of the City of Cibolo, Guadalupe County, Texas; and WHEREAS, the City of Cibolo, Guadalupe County, Texas, is a home rule municipality that may annex the right-of-way for Dietz Road pursuant to Section 43.0545 of the Texas Local Government Code; and WHEREAS, Dietz Road is a substandard road that requires certain improvements; and WHEREAS, both Guadalupe County, Texas, and the City of Cibolo, Guadalupe County, Texas, have agreed to the improvements necessary to bring Dietz Road to an acceptable standard; and Page 1 of 5 WHEREAS, this Resolution will be adopted by the Commissioners Court of Guadalupe County, Texas, and the City Council of the City of Cibolo, Guadalupe County, Texas, and reflects the intent of both parties to this Resolution to make certain improvements to Dietz Road and the intent by the City Council of the City of Cibolo, Guadalupe County, Texas, to annex that portion of the right-of-way for Dietz Road that is located within its extraterritorial jurisdiction upon completion of certain improvements to Dietz Road; and WHEREAS, the Commissioners Court of Guadalupe County, Texas, and the City Council of the City of Cibolo, Guadalupe County, Texas, shall each adopt this Resolution in a posted public meeting and acknowledge that it is their intention to complete certain improvements to Dietz Road in preparation for the annexation of the Dietz Road right-of-way by the City of Cibolo, Guadalupe County, Texas; and WHEREAS, each party, by the adoption of this Resolution, acknowledges the intention to complete certain improvements to Dietz Road and acknowledges the intention of the City Council of the City of Cibolo, Guadalupe County, Texas, to annex that portion of the Dietz Road right-of-way within its extraterritorial jurisdiction. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF GUADALUPE COUNTY; TEXAS, AND THE CITY COUNCIL OF THE CITY OF CIBOLO, GUADALUPE COUNTY, TEXAS: SECTION 1. The Commissioners Court for Guadalupe County and the City Council for the City of Cibolo are both adopting this Resolution to acknowledge their desire make certain improvements to that portion of Dietz Road within the City of Cibolo's Page 2 of 5 extraterritorial jurisdiction and their desire for the City of Cibolo to annex that portion of Dietz Road within the City's extraterritorial jurisdiction upon completion of certain improvements to that portion of Dietz Road within the City of Cibolo's extraterritorial jurisdiction. SECTION 2. This Resolution will be adopted at a public meeting by the Commissioners Court of Guadalupe County and the City Council of the City of Cibolo no later than August 9, 2005. SECTION 3. Both the City and the County acknowledge that the following improvements and the responsible party for each improvement reflect the agreed upon improvements required pursuant to this Resolution: Improvement Responsible Party Extend the concrete curb to the radius at Borgfeld Road for the west side of Dietz Road. Guadalupe County Place a wheelchair ramp in the sidewalk at the radius at Borgfeld Road for the east side of Dietz Road(at the Borgfeld-Dietz Road Guadalupe County intersection). Level up the asphalt to match gutter elevations for the entire roadway section of Dietz Road. Guadalupe County Extend the concrete curb at the radius of the Town Gate Road intersection. Guadalupe County Place a wheelchair ramp, street side only, at the walkway to the Watts Elementary School campus. Guadalupe County Re-seal the entire roadway subject to this Resolution. Labor Guadalupe County Equipment Guadalupe County Oil Guadalupe County Rock City of Cibolo Restripe the entire roadway section. GuadalupeCoun Page 3 of 5 The improvements outlined in this section aresubject to periodic inspection by the City of Cibolo and shall be installed to a standard mutually agreed to by the City Engineer for the City of Cibolo and the Guadalupe County Road and Bridge Administrator. The City Engineer for the City of"Cibolo,shall be present when re-sealing of the road surface is conducted and the roadway improvements specified in this SECTION 3 shall be deemed complete at such time that the re-sealing is finished and provided that the other improvements are comp lete,wand installed prior to the re-sealing. Upon completion of the improve ments"as specified in this SECTION 3 the City of Cibolo shall be responsible for further maintenance of Dietz Road. SECTION 4. The City Council of the City of Cibolo will initiate annexation proceedings for that portion of the Dietz Road right-of-way located within its extraterritorial jurisdiction within thirty (30) days of the completion of improvements as specified in SECTION 3 of this Resolution. SECTION 5. This Resolution shall not be effective unless passed and adopted by both the Commissioners Court for Guadalupe County and the City Council for the City of Cibolo.
