RES 1311 08/23/2005 RESOLUTION#1311 A RESOLUTION OPPOSING THE CITY OF SAN ANTONIO'S AMENDMENTS TO THE SAN ANTONIO MUNICIPAL SOLID WASTE CODE, CHAPTER 14, SECTION 22, RELATING TO THE "WASTE HAULER PERMITS" THAT WILL IMPOSE AN ANNUAL FEE OF $2,250 ON ALL SOLID WASTE VEHICLES THAT SERVE THE CITY OF CIBOLO AND CIBOLO'S NEIGHBORHING COMMUNITIES THAT DUMP WASTE IN LANDFILLS LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY OF SAN ANTONIO,TEXAS. WHEREAS,the City Council of the City of Cibolo,Guadalupe County,Texas,passed and approved Ordinance Number 628 on March 9,2004,thereby granting a solid waste franchise to Bexar Waste, and WHEREAS,Bexar Waste has contracted with BFI to dispose of solid waste at a landfill located on I.H. 10 in the City limits of the City of San Antonio, and WHEREAS,the landfill in which the City's solid waste is deposited is a privately owned and operated facility, and WHEREAS,Bexar Waste does not utilize any roads for which the City of San Antonio has maintenance responsibility, and WHEREAS,the proposed amendments to the Solid Waste Code cannot be applied and enforced equitably for all commercial and industrial haulers that collect,transport or dispose of solid waste within the corporate limits of the City of San Antonio, and WHEREAS,the proposed amendments to the Solid Waste Code will apply a fee and directly increase the cost to the citizens of Cibolo and other communities within the greater San Antonio area that is unfair and inequitable, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO,GUADALUPE COUNTY,TEXAS: The City of Cibolo, Guadalupe County, Texas,hereby opposes the proposed amendments to the City of San Antonio Municipal Solid Waste Code that will add additional fees and costs to the City of Cibolo and fellow communities within the greater San Antonio area.
