RES 1295 11/23/2004 RESOLUTION NUMBER / a 95 A RESOLUTION OF THE CITY OF CIBOLO REQUESTING AN EXTRATERRITORIAL JURISDICTION SWAP WITH THE CITY OF SCHERTZ FOR THE 14.30 ACRES ADJACENT TO BOTH OF OUR CITY LIMITS KNOWN AS OLD WIEDERSTEIN ROAD. WHEREAS, Old Wiederstein Road connects to Cibolo Valley Drive which serves as the main thoroughfare entrance to the City of Cibolo from Interstate Highway 35, and WHEREAS, the City of Cibolo paid Guadalupe County for upgraded improvements made to Old Wiederstein Road to city standards from Interstate 35 to Cibolo Valley Drive, and WHEREAS, Texas Local Government Code Section 42.024 does allow for the transfer of extraterritorial jurisdiction between municipalities, and WHEREAS, late in the year 2001, the Cities of Cibolo and Schertz did approve a transfer of ETJ in the Northcliff area during the annexation process of those properties by the City of Schertz, and WHEREAS, the City of Cibolo desires to assume full responsibility for maintenance of Old Wiederstein Road from Interstate 35 to Cibolo Valley Drive, NOW THEREFORE, BE IT RESOLVED that the City Council of Cibolo requests the City Council of Schertz consider an Extraterritorial Jurisdiction swap for the 14.30 acres adjacent to both of our existing city limits known as Old Wiederstein Road.
