RES 1368 06/24/2008 RESOLUTION NO. 1368 A RESOLUTION AMENDING THE 2008 SERVICE PLAN FOR AREAS DESCRIBED BY THE ANNEXATION MAP AS TRACTS A-K BEING CONSIDERED FOR ANNEXATION ON JUNE 24, 2008; ALLOWING RESIDENTS TO KEEP THEIR CURRENT SEPTIC SYSTEM; AND PROVIDING FOR OTHER EXCEPTIONS. WHEREAS, on April 22, 2008, the City Council passed Ordinance No's 837, 838, 839 and 840, setting the dates and times of public hearings and directing the City Manager to prepare a service plan for certain areas proposed for annexation; and WHEREAS, pursuant to Tex. Loc. Gov't Code Section 43.056(g) the City must provide a level of services that is comparable to the level of services available in other parts o the municipality with topography, land use, and population density similar to those reasonably contemplated or projected in the area; and WHEREAS, on May 27, 2008 and May 29, 2008 the City Council held public hearings regarding the annexation of certain areas described by the annexation map as Tracts A-K being considered for annexation on June 24, 2008; and WHEREAS, during the public hearings the residents of the areas proposed for annexation raised concerns regarding the retention of their current septic systems; and WHEREAS, in order to address some of these concerns, the City Council finds it prudent and in the best interest of the City to amend the current service plan to address the status of these septic systems; and WHEREAS, the City Council finds it appropriate to allow the residents who currently own a septic system to continue to use such a system with certain exceptions; and WHEREAS, within the areas proposed for annexation the City Council believes that a home-owner should connect to a sewer line if it is located within 500 feet of the property line in order to protect the health, safety and welfare of other citizens.. NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS. The Service Plans for the 2008 Annexation of Tracts A-K being considered for annexation on June 24, 2008 is hereby amended to add the following section: Section 5. Maintenance of Current Septic System Any resident who currently utilizes a septic system to manage wastewater shall be entitled to continue said system except for the following: Should a septic system located within 500 feet of an existing sewer main fail to the point where repair costs will exceed the cost of replacement, the property owner shall be required to connect to the sewer main.
