RES 1272 02/10/2004 RESOLUTION I Resolution to set a date,time and place for a Joint City Council and Planning and Zoning Joint Hearing on the proposed annexation and R-2 zoning of a said tract of land being 1.470 acres (54,035 sq.ft.)of land out of a 7.22 tract s recorded in Volume 621,Page 364, of the Deed Records of Guadalupe County, Texas and situated in the Trinidad Garcia Survey,Abstract Number 1371and more or less, situated in the SEXTO Dominguez Survey No. 152, Abstract No. 110, Guadalupe County, Texas. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS. Section 1. That Joint two Public Hearings will be held to such discuss proposed annexation and R-2 zoning,the first being with City Council on Tuesday,February 24, 2003 at 6:45 P.M. in the Cibolo City Hall; and the second being a joint City Council and Planning and Zoning being held on Tuesday,March 9,2004, at 6:30 P.M. in the Cibolo City Hall,for the purpose of providing all interested persons the opportunity to be heard concerning the proposed R-2 Zoning of 1.470 acres of land by the City of Cibolo. Section 2. The description of the 1.470 acres of land which is proposed to be annexed and zoned R-2 is as follows: Point of Beginning at a point for the northern most corner of said 7.22 acre tract and Beginning the Point of Beginning of the tract herein described;Thence S 30. 39'03"E A distance of 244.49 feet to a point for the southeast corner of the tract herein described: Thence Thence S 59. 18'53" W crossing said 7.22-acre tract for a distance of 261.92 Feet to a point on the west line of said 7.22 acre tract" Thence N 30'04" w along said line for a distance of 244.49 feet to a point for the northwest corner of the tract herein described: Thence N 59. 18'53"E for a distance of 261.92 feet to the point of Beginning and Containing 1.470 acres of land more or less. Ingress and Egress and public Utilities Easement recorded in Volume 599,Page 740, Volume 599,Page 744,Volume 599,Page 748,Volume 599,Page 753,Volume 599, page 757,and volume 599,Page 761,Deed Records, Guadalupe County, Texas and as shown on survey dated July 17,2002 by Don McCrary&Associates. 3. Easement and Agreement recorded in Volume 631,Page 768, Deed Records, Guadalupe County, Texas. 4. Water Pipe line Easement recorded in Volume 58,Page 83,Deed Records, Guadalupe County, Texas. 5. Oil, Gas and Mineral Lease,and all terms, conditions and stipulations therein recorded in Volume 259,Page 429,Deed Records,Guadalupe County, Texas. Title to said interest has not been investigated subsequent to the date of the aforesaid instrument. Section 3. This resolution shall be effective immediately upon its passage and approval.
