RES 1268 01/13/2004 RESOLUTION �� �� (Ms. Eva Hecox,216 Rhea, 0.69 acres) Resolution is to set a date,time and place for a City Council and a Joint City Council and Planning and Zoning Hearing on the proposed rezoning from R-2 to C-1 Zoning of a said tract of land being of 0.69 acres of land in Guadalupe County, Texas,out of the A.S. Lewis Survey 78,Abstract 216, being comprised of a portion of a 1 acre tract described in conveyance from Henry Remmler and wife,Katie Remmler to Alvin Remmler of record in Volume 235,Page 620-621,Deed Records of Guadalupe County, Texas a portion of a 0.685 acre tract described in conveyance from Henry Remmler to Alvin Remmler or record in Volume 369, Page 541,Deed Records of Guadalupe County, Texas. Said 1-acre tract and 0.685 acre tract both being a portion of a 31.6-acre tract of record in Volume 218,Page 180-183, Deed Records of Guadalupe County, Texas. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS. Section 1. That two Public Hearings will be held to such discuss rezoning,the first being on Tuesday, January 27,2004,at 6:30 P.M. in the Cibolo City Hall with Cibolo City Council; and the second being a joint public hearing with City Council and Planning and Zoning on Tuesday,February 10,2004,at 6:30 P.M. in the Cibolo City Hall,for the purpose of providing all interested persons the opportunity to be heard concerning the proposed rezoning from R-2 to C-1 zoning of 0.69 acres of land by the City of Cibolo. Section 2. The description of the 0.69 acres of land which is proposed to be rezoned C-1 is as follows: DESCRIPTION OF AN 0.69 ACRE TRACT OF LAND BEGINNING: at a''h"iron pin found on the Southwest right-of-way line of Rhea Street,a dedicated street as platted in Four Leaf Park,in Volume 3,Page 22-23,Plat Records of Guadalupe County,Texas, same being the Northeast boundary line of said 1 acre tract at the Northeast corner of a 0.156 acre tract described in conveyance to Charles A.&Judy A.Muenehow,of record in Volume 762,Page 1151-52,Deed Record of Guadalupe County,Texas,for the Southeast corner this herein described tract,Being: North 30 deg.00 min.00 sec. West, 136.00 feet from a%i"iron pin found at the intersection of the Southwest right-of-way line of said Rhea Street the North right-of-way line of F.M.Road No. 78; THENCE: South 59 de,26 min,21 sec,West,a distance of 70.08 feet along with fence line on the Northwest boundary line of said Muenehow 0.156 acre tract to a%Z"iron pin set at the East corner of a 0.403 acre tract described in conveyance to John Edward Brinkmeyer,et al,of record in Volume 417, Page 183,Deed Records of Guadalupe County,Texas,for the South corner of this herein described tract: THENCE: North 40 deg.39 min.26 sec. West,a distance of 238.31 feet along with the Northeast boundary line of said Brinkmeyer,et al,0.403 acre tract to a''/z"iron pin found on the Southeast boundary line of a 0.164 acre road easement described in conveyance to John Edward Brinkmeyer,it al,of record in Volume 417,Page 183,Deed Records of Guadalupe County,Texas,at the North corner of said Brinkmeyer 0.403 acre tract,for the West corner a this herein described tract; THENCE: North 31 deg. 15 min. 15 sec.East,a distance of 234.45 feet along with the Southeast boundary line of said Brinkmeyer 0.164 acre road easement to a'/2"set on the South right-of way line of Pfeil Street(formerly Old Cibolo-Schertz Road)and same being the North boundary line of said 0.685 acre tract at the Northeast corner of said Brinkmeyer 0.164 acre road easement,for the Northwest comer of this herein described tract; THENCE: North 89 deg.58 min.21 sec.East,a distance f 46.85 feet along with the South right-of-way line of said Pfeil Street(formerly Old Cibolo-Schertz Road)and same being the North boundary line of said 0.685 acre tract to a%,"iron pin set at the intersection of the South right-of-way line of said Pfeil Street(formerly Old Cibolo-Schertz Road)with the Northwest right-of-way line of said Rhea Street at the Northeast corner of said 0.685 acre tract,for the Northeast corner of herein described tract; THENCE: South 31 deg.41 min.43 sec.
