RES 1264 12/09/2003 RESOLUTION NUMBER A RESOLUTION OF THE CITY OF CIBOLO REQUESTING GOVERNOR RICK PERRY AND THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY STAND FIRM ON ITS RECOMMENDATION TO THE ENVIRONMENTAL PROTECTION AGENCY OF AN ATTAINMENT DESIGNATION IN AIR QUALITY FOR GUADALUPE COUNTY. WHEREAS, the Clean Air Act clearly defines the 8-hour ozone national ambient air quality standard as the basis for an attainment designation, and WHEREAS, ozone monitors in Guadalupe County recorded air quality within the Clean Air Act's 8- hour standard at the New Braunfels Airport for two years and in the City of Seguin this year, and WHEREAS, TCEQ and Governor Rick Perry recommended an attainment designation in air quality for Guadalupe County based on the Clean Air Act's 8-hour ozone standard, and WHEREAS, EPA Regional Administrator Richard Greene, in a letter to Governor Rick Perry dated December 3, 2003, recommends Guadalupe County be included in the San Antonio MSA nonattainment boundary area based on an EPA guidance memorandum, and WHEREAS, the rule of law demands that the law; in this case, the Clean Air Act's 8-hour ozone standard, is entitled to greater weight than an EPA self-generated guidance memorandum, NOW THEREFORE, BE IT RESOLVED that the City Council of Cibolo requests the rule of law be upheld and that Governor Rick Perry and TCEQ stand firm on its recommendation of an attainment designation in air quality for Guadalupe County. We also request that the Guadalupe County Commissioners' Court and the Alamo Area Council of Government's Air Executive Committee pass and approve a similar resolution.
