AUTHORIZING THE APPLICATION TO THE CRIMINAL JUSTICE DIVISION,
OFFICE OF THE GOVERNOR OF THE STATE OF TEXAS, FOR GRANT FUNDING
TO THE ALAMO AREA NARCOTICS TASK FORCE PROJECT TO BE USED TO
PAY THE OPERATING EXPENSES OF THIS PROJECT AND TO SUPPORT THE
COST OF PROVIDING ADDITIONAL PERSONNEL, EQUIPMENT, FACILITIES,
PERSONNEL TRAINING AND SUPPLIES FOR MORE WIDESPREAD
APPREHENSION OF PERSONS WHO VIOLATE FEDERAL, STATE AND/OR
LOCAL LAWS RELATING TO THE PRODUCTION, TRANSPORTATION AND
DISTRIBUTION OF CONTROLLED SUBSTANCES, VIOLENT CRIME AND
CRIMINAL NARCOTIC ACTIVITIES IN THE JURISDICTION OF THE ALAMO
AREA NARCOTICS TASK FORCE PROJECT.
WHEREAS, V.T.C.A., Local Government Code, section 362.001 et. Seq.
Authorizes the creation of multi jurisdictional, mutual aid, law enforcement task forces to
co-operate in criminal investigations and law enforcement; and
WHEREAS, the Alamo Area Narcotics Task Force has been created to aid in
the detection, apprehension, and prosecution of cases arising out of violations of federal,
state, and local laws concerning the production, transportation and distribution of
controlled substances, violent crime and criminal narcotic activities; and
WHEREAS, the City of Cibolo has approved expenditures of grant funds and the
participation of one police officer in such task force operations.
WHEREAS, The Governor's Office, Criminal Justice Division, State of Texas, has
indicated that federal funds are available for a Texas Narcotics Control Program under
the Anti-Drug Abuse Act of 1986 for the period of July 1, 2003 through May 31, 2004
and
WHEREAS, the City of Cibolo will submit an application for a grant of funds to
the Alamo Area Narcotics Task Force Project, a multi jurisdictional, multi-agency,
narcotic trafficking task force of The City of Cibolo, and other participant entities of the
Alamo Area Council of Governments area, to include the City of Cibolo; and
WHEREAS, the project will support the costs associated with the detection,
interdiction, apprehension and prosecution of persons who violate federal, state, and/or
local laws relating to the production, transportation and distribution of controlled
substances, violent crime and criminal narcotic activities in the jurisdiction of the Alamo
Area Narcotics Task Force Project; and
WHEREAS, the City of Cibolo, believes it to be in the best interest of the City of
Cibolo, to join in the application for a grant of funds from the Criminal Justice Division,
Governor's Office, State of Texas, to the Alamo Area Narcotics Task Force; and
WHEREAS, the City of Cibolo, has agreed that in the event of loss or misuse of
the Criminal Justice Division funds that are received by the City of Cibolo, the City of
Cibolo assures the funds will be returned to the Criminal Justice Division in full.
NOW, THEREFORE, be it resolved that:
The City of Cibolo, hereby authorizes the Mayor of The City of Converse to
submit an application on behalf of the City of Cibolo, Texas, for the funding for
personnel costs, direct operating expenses, contract services, travel, equipment and other
miscellaneous expenses related to the operation of the Alamo Area Narcotics Task
Force.
To comply with the requirements of the grant application, funding of matching
moneys must be guaranteed in the same amount as the funds obligated by the grantee, the
City of Converse. The matching funds for the grant for the Alamo Area Narcotics Task
Force, ( historically an amount equal to one-fourth of the total project cost), will be first
supplied by the program income or forfeited funds awarded to the Alamo Area
Narcotics Task Force, and if the program income is not sufficient, each participating
entity, to include the City of Cibolo, will be liable for, and will provide on demand, a
percentage of the remaining balance of the matching funds. The amount of this
percentage share of the matching funds will be determined by dividing the number of
participating entities of this project into the remaining matching funds obligation.
The City of Converse shall be the administering agency for all of the funds under
this grant.
