RES 1345 12/12/2006 R—PSOLUTIOIN A RESOLUTION APPEALING THE CITY OF SAN ANTONIO'S WASTE HAULER PERMIT FEES AND ASSUES,CITY ORDINANCE chapter 14,Article III,Section 14-22 Commercial/Industrial Haulers,No.71131. WHEREAS, the City of Cibolo appeals to the City of San Antonio's Planning and Zoning Commission and Architectural Review Board concerning Waste Hauler Permit Fees and issues Ordinance,Chapter 14,Article III, Section 14-22 Commercial/Industrial Haulers,No. 71131; and WHEREAS, the City of San Antonio has a long term contract,worth millions of dollars with landfills owned by Waste Management&Allied Waste,to dispose of the City of San Antonio's own solid waste; and WHEREAS, the City of San Antonio is requiring"Independent waste haulers"with trucks weighing more than 7,000 pounds,with any type of waste,to pay$2,250.00 per truck,per year for hauling/disposing of waste within the city limits,at third party landfills; and WHEREAS, the City of San Antonio has exempted their entire truck fleet,and has agreed to charge only$25.00 per truck,per year, for any size truck for the cities of Alamo Heights,Terrell Hills,Olmos Park and Castle Hills; and WHEREAS, the City of Cibolo is of the opinion that the City of San Antonio's Ordinance No. 71131 is unconstitutional and stifles fair competition and represents an unfair restraint of trade; and WHEREAS, there is no cap on fees and the City of San Antonio could continue to raise annual fees,at will. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO,GUADULUPE COUNTY,TEXAS: that we oppose the $2,250.00 fee charged and request the City of San Antonio to approve Bexar Waste, a private collector and who has a contract with the City of Cibolo,to receive a$25.00 charge.
