Call to Order—Meeting was called to order by Chairman Mr. Coursen at 6:30 p.m. 2. Roll Call—Members Present:Mr.Coursen,Mr.Winters,Mr.Felder,Ms.Mashburn,Mr.Welch,Mr. Farnsworth and Mr.Doty;Members Absent:None; Staff Present:Mr. Stricker,Mr.Anderson,Ms. Cimics, and Ms.Gonzales; Council Present: Council Members: Hale,Liparoto and Carlton. 3. Moment of Silence—Chairman called for a moment of silence. 4. Pledge of Allegiance—All in attendance recited the Pledge of Allegiance. . 5. Citizens to be Heard: This is the opportunity for visitors and guests to address the Planning and Zoning Commission on any issue.Planning and Zoning Commission may not debate any non-agenda issue,nor may any action be taken on any non-agenda issue at this time however the Planning and Zoning Commission may present any factual response to items brought up by citizens. No citizens spoke at this time. 6. Public Hearing A. The City of Cibolo Planning and Zoning Commission will hold public hearing to hear public testimony concerning assignment of permanent zoning from the Agricultural (AG) district to the High Intensity Single-Family Residential (SF-3) district for approximately 21.303 acres along the east side of FM 1103 north of the Mesa at Turning Stone and Landmark Pointe subdivisions that may be annexed into Cibolo on December 10, 2013 and the rezoning of 12.194 acres immediately north of the Mesa at Turning Stone and Landmark Pointe subdivisions from the Rural Single-Family Residential (SF-1) district to the High Intensity Single-Family Residential (SF-3) district; which combined result in a total of 33.497 acres being rezoned to SF-3. Chairman opened the Public Hearing at 6:35. Rita Bell and Douovan Butter of 210 Scenic Hill Lane spoke to the commission with concerns of flooding and the number of homes being built and the traffic issues that come with that. No other comment and the Chairman Mr. Coursen closed the Public Hearing at 6:39 p.m. B. The City of Cibolo Planning and Zoning Commission will hold public hearing to hear public testimony concerning assignment of permanent zoning from the Agricultural (AG) district to the General Commercial (C-4) district for approximately 5.001 acres located along the west bound I-10 frontage road between Santa Clara Road and Zuehl Road that may be annexed into Cibolo on December 10, 2013. Chairman Coursen opened the Public Hearing at 6:39. No citizen spoke on this item and the Chairman closed the Public Hearing at 6:41 p.m. C. The City of Cibolo Planning and Zoning Commission will hold a Public Hearing on to hear public testimony regarding the rezoning of approximately 98.406 acres immediately north of Turning Stone and west of FM 1103, of which approximately 92.32 would be rezoned from the Single-Family Residential (SF-1) zoning district to the Single Family Residential (SF-3) zoning district and approximately 6.086 acres fronting FM 1103 from the Single-Family Residential (SF-1) zoning district to the Retail Office (C-3) zoning district to match the residential and commercial zoning of properties in the adjoining Turning Stone development. The Chairman Mr. Coursen opened the Public Hearing at 6:42 p.m. The applicants (Paul Denham), Nicholas Ramones and (Steve Raub) gave a presentation to all in attendance. The following individuals signed up to be heard on this Public Hearing: Iliana Pena of 13152 Remuda, San Antonio, Donald Schaezler of 19349 Old Wiederstein Rd, Georgina Schwartz of 3006 Belvoir, San Antonio, Teresa Keck of 118 Cloverleaf, San Antonio, Sharon Kay of 341 Burkwood Ln, Cibolo, Beth Gregory of 627 Dean Rd, Cibolo, Thora and Esther Yoon of 11215 Rocky Trail, San Antonio, Nancy Friesenhahn of 2745 FM 1103, Cibolo, Michelle Flores of 9143 Laguna Hills, San Antonio, Greg Pasztor of 126 Cutmount, San Antonio, Susan Schaezler of 19349 Old Wiederstein Rd,Robbie and Steven Berg of 581 Dean Rd, Cibolo. All individuals spoke against the zoning as they want to protect the habitat for birds, preserve trees, native shrubs and grasses. The Chairman closed the Public Hearing at 7:45 p.m. D. The City of Cibolo Planning and Zoning Commission will hold a Public Hearing to hear public testimony concerning approximately 143.5 acres concerning the assignment of permanent zoning from the Agricultural (AG) district to the Single-Family Residential (SF-3) district for approximately 143.5 acres south of Green Valley Road, north of Weidner Road, east of Town Creek East that may be annexed into Cibolo on December 10, 2013. This item was pulled by the applicant. E. The City of Cibolo Planning and Zoning Commission will hold a Public Hearing to hear public testimony concerning possible amendments to the Future Thoroughfare Plan for the area bounded by Cibolo Valley Drive, FM 1103 and Green Valley Road. Particular emphasis will be given to Buffalo Crossing, Weidner Road, Town Creek Road and a proposed arterial to connect FM 1103 in the vicinity of Steele High School with Green Valley Road. Chairman Mr. Coursen opened the Public Hearing at 7:45 p.m. No one spoke and the Public Hearing was closed at 7:45 p.m. 7. Approval of Minutes: A. Approval of the minutes from the October 9, 2013 regular Meeting. Minutes were tabled and will be brought back at the next meeting. 8. Discussion/Action A. Discussion/Action and recommendation to the City Council regarding the assignment of zoning to 21.303 acres of land that may be annexed into Cibolo to SF-3 and the rezoning of an adjoining 12.194 acre tract in Cibolo from SF-1 to SF-3;resulting in 33.497 acres proposed to be zoned SF-3. Mr. Anderson the City Planner explained this item to the commission and he tried to address the drainage issues brought up during the Citizens to be Heard area of the agenda. Mr. Winter made the motion to recommend approval to the City Council the assignment of zoning to 21.303 acres of land that may be annexed into Cibolo to SF-3 and the rezoning of an adjoining 12.194 acre tract in Cibolo from SF-1 to SF-3;resulting in 33.497 acres proposed to be zoned SF-3. The motion was seconded by Ms. Mashburn. For: Commissioners: Felder,Welch Winter and Mashburn; Against: Commissioners Farnsworth and Doty. Motion carried 4 to 2. B. Discussion/Action and recommendation to the City Council regarding the assignment of zoning to 5.001 acres of land that maybe annexed into Cibolo to C-4. Mr. Doty made a motion to approve and recommend to the City Council the assignment of zoning to 5.001 acres of land that maybe annexed into Cibolo to C-4. Motion was seconded by Mr. Welch. For: Commissioners: Winter, Mashburn, Felder,Farnsworth, Doty and Welch;Against: None. Motion carried 6 to 0. C. Discussion/Action and recommendation to the City Council regarding the rezoning of 92.32 acres from SF-1 to SF-3 and 6.086 acres from SF-1 to C-3. This item consisted of two separate actions: First motion was made by Ms. Mashburn to recommend approval to City Council the rezoning of 6.086 acres from SF-1 to C-3. Motion was seconded by Mr. Doty. For: Commissioners Mashburn,Doty, Felder Winters and Welch; Against: Commissioner Farnsworth. Motion carried 5 to 1. The second motion was made by Ms. Mashburn to recommend to City Council approval of the rezoning of 92.32 acres from SF-1 to SF-3 with the condition that the density not to exceed 3 lots an acre. Motion was seconded by Mr. Felder. For: Commissioner Felder, Farnsworth and Mashburn; Against: Commissioner Welch,Winter and Doty. Due to a tie vote the Chairman was required to cast a vote on this issue. Mr. Coursen voted against the motion and the motion failed to pass by a vote of 3 to 4. Mr. Winter made the motion to deny approving the request for a rezoning of 92.32 acres from SF-1 to SF-3. Motion was seconded by Mr. Doty. For: Commissioners: Farnsworth,Welch, Winter, Doty and Felder; Against: Ms. Mashburn. Motion carried 5 to 1 to deny zoning request. D. Discussion/Action and recommendation to the City Council regarding amendments to the City of Cibolo Future Thoroughfare Plan. Mr.Welch made the motion to recommend to the City Council approval of the amendments to the City of Cibolo Future Thoroughfare Plan. Mr. Doty seconded the motion. For: Commissioners: Felder, Mashburn, Doty,Welch, Farnsworth and Winter; Against: None. Motion carried 6 to 0. E. Discussion/Action and recommendation to the City Council regarding the Foxbrook Land Study. Mr. Doty made the motion to recommend to the City Council disapproval of the Foxbrook Land Study for not meeting the SF-1 zoning requirement. Motion was seconded by Mr. Welch. For: Commissioners: Felder,Mashburn, Doty,Welch, Farnsworth and Winter; Against:None. Motion carried 6 to 0. F. Discussion/Action and recommendation to the City Council regarding the Final Plat of Cibolo Summit Phase I (ROW, Easements, Common Areas and Parkland) and a variance to allow a 10' super-sidewalk on one side of Green Valley Road in lieu of 5' sidewalks on each side of Green Valley Road. This item was separated into two separate motions. First motion was made by Mr. Doty to recommend to the City Council the approval of the Final Plat of Cibolo Summit Phase I(ROW, Easements, Common Areas and Parkland). Motion was seconded by Ms. Mashburn. For: Commissioners Doty, Mashburn,Felder,Winter, Farnsworth and Welch; Against:None. Motion carried 6 to 0. The second motion was made by Ms. Mashburn to recommend to City Council approval of the variance to allow 8' super-sidewalk on one side of Green Valley Road in lieu of 5' sidewalks on each side of Green Valley Road subject to staff recommendations. Motion was seconded by Mr.Winter. For: Commissioners: Welch, Felder, Doty, Farnsworth, Winter and Mashburn; Against: None. Motion carried 6 to 0. G. Discussion/Action and recommendation to the City Council regarding the Preliminary Plat of Cibolo Summit Unit 1. Mr. Doty made the motion to approve and recommend to the City Council the Preliminary Plat of Cibolo Summit Unit 1. Motion was seconded by Mr. Farnsworth. For: Commissioners: Felder,Mashburn, Doty, Welch,Farnsworth and Winter; Against: None. Motion carried 6 to 0. H. Discussion/Action and recommendation to the City Council regarding the Preliminary Acceptance of Turning Stone Unit W-3. Mr. Farnsworth made the motion to approve and recommend to the City Council the Preliminary Acceptance of Turning Stone Unit W-3. Motion was seconded by Mr. Doty. For: Commissioner Members: Felder,Winter,Welch, Mashburn, Doty and Farnsworth; Against: None. Motion carried 6 to 0. 9. UDC and OP Updates, Discussion and Reports—No updates at this time. 10.
