ORDINANCE NO. 217
AN ORDINANCE by the City Council of the City of Cibolo, Texas,
revising rates and charges for services furnished by the
City's Waterworks and Sanitary Sewer System; enacting
provisions incident and related to billing and collection
of water and sewer charges; repealing all ordinances, orders
and resolutions in conflict; prescribing a date such rates
and charges shall become effective and declaring an emergency.
WHEREAS, this Council has determined that the rates and charges for
water furnished by the City's Waterworks System should be revised; therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS;
SECTION 1: That the rates or charges for water furnished by the City
Waterworks System shall be and are hereby revised and established to be as
follows:
RESIDENTIAL WATER RATES: (Monthly Billing)
First 3,000 gallons $9.00 (minimum)
Next 5,000 gallons 1.40 per 1,000 gallons
Over 8,000 gallons 1.20 per 1,000 gallons
COMMERCIAL WATER RATES: (Monthly Billing)
First 3,000 gallons $12.00 (minimum)
Next 5,000 gallons 1.10 per 1,000 gallons
Over 8,000 gallons 1,20 per 1,000 gallons
TAPPING FEE Not less than actual
cost to the City
METER DEPOSIT $30.00
RECONNECTION CHARGE $ 3.00
WHEREAS this Council has also determined that the rates and charges for
sewer furnished by the City's Sanitary Sewer System shall be and are hereby revised
and established as follows:
Sewer rates shall be based on the three month average of water
usuage for the months of December, January and February of each
year. All shall be figured and adjusted each year at the time
such average is established as follows:
RESIDENTIAL SEWER RATES: (Monthly Billing)
First 3,000 gallons of established average water usuage $7 .00 (minimum)
Thereafter per 1,000 gallons established ave. water usuage .90
COMMERCIAL SEWER RATES:
First 3,000 gallons of established average water usuage $9 .00 (minimum)
Thereafter per 1,000 gallons:nf established ave:., .water usage .90
SECTION 3: That all water services shall be furnished on a metered basis
and a separate meter shall be installed for each family dwelling, business
establishment, or property served with water, i.e., there shall be no dual
connections or more than one user on a single meter.

SECTION 4: That the rates and charges hereby fixed and established for
the City's Waterworks System and Sanitaru Sewer System shall be paid to the
City Secretary of the City of Cibolo, Texas
SECTION 5: That all monthly charges for water and sewer services shall
be billed and collected simultaneously and shall become due and payable on the
10th day of each month; and if the total amount due the City each month is not
paid within fifteen (15) days from the date the same becomes due and payable,
a ten percent (10%) charge shall be added to the amount past due and unpaid.
SECTION 6: That the failure of a customer or user of the Waterworks
System, the Sanitary'Sewer System, or both Systems to pay a monthly charge
within thirty (30) days from the date the same becomes due and payable shall
be grounds for the City to disconnect the services so supplied; and such
service shall not be resumed until the total amount due the City and the
reconnection fee for the service disconnected has been collected.
SECTION 7: That no free service shall be allowed, and to the extent the
City or any of its agencies or instrumentalities avail themselves of the services
and facilities provided by the Waterworks and Sanitary Sewer System, they shall
pay therefor the same rates and charges herein prescribed.
SECTION 8: The rates and charges herein provided for the Waterworks
System shall be effective as of the next billing date; the rates and charges
provided for the Sanitary Sewer System shall be effective as of the next
billing date.
SECTION 9: That all ordinances, orders or resolutions, or parts thereof
heretofore passed and adopted by the City Council in conflict herewith, shall
be and the same are hereby repealed.
SECTION 10: The fact that it is to the best interest of the City to revise
the rates being charged by the_City's Waterworks System and Sewer System at the
eartliest possible date constitutes andcreates an emergency and an urgent public
necessity requireing that this ordinance be passed and take effect as an emergency
measure, and that any rule requiring ordinances to be read more than one time or
at more than one meeting be suspended, and any such rules are hereby suspended
and this ordinance is accordingly passed as an emergency and shall take effect and
be in force from and after its passage.
