ORD 241 08/04/1977 • +�f� • 1111114411 ORDINANCE NO. 2141 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF CIBOLO, TEXAS, AUTHORIZING AND DIRECTING THE MAYOR TO PUBLISH NOTICE OF SUCH PUBLIC HEARING AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: SECTION I. On the 22 day of August , 1977, at 6:00 o'clock in the City Hall of the City of Cibolo, Texas the Council will hold a public hearing giving all interested persons the right to appear and be heard on the proposed annexation by the City of Cibolo, Texas of the following described property, to wit: Being all that certain tract or parcel of land situated in Guadalupe County, Texas, being part of the A.S. Lewis Survey No . 78, Abstract No . 216, Certificate No. 1639, Patent No. 272, Volume 1 , and being a portion of a tract of 190 acres conveyed by Sebastian Schertz et al to Johann G. Bergfeldt by deed dated December 1 , 1851 , and recorded in Volume D, page 138, of the tract of 100 acres conveyed to Melchior Amacker by Sebastian Schertz et al by deed dated December 2, 1851 , and recorded in Volume I, page 1+88, of said deed records and the particular portion thereof hereby conveyed being described by mettis and bounds as follows, to wit: BEGINNING at a point in the north line of a 140 foot road running along the north side of the G.H. & S.A. Railroad Company right of way, said point being the division line between this tract and the Brotzke land and being 90 feet distance from the center of said railroad right of way; THENCE North 1° 43' West along said division line 839 .5 varas to a stake, the Southwest corner of the Joe Anacker 90.25 acre tract; THENCE South 82° East with the south line of the Joe Amacker tract, 8)45 varas to a stake in the Northwest line of a 30 foot road for the Northeast corner of this tract; THENCE South 21° 30' West along the Northwest line of said road 731 .5 varas to its intersection with the north line of the above mentioned 110 foot road running along the north side of said railway right of way; THENCE South 814° West along the north line of said 140 foot road, 522 varas to the place of beginning, containing 90.5 acres more or less . ALSO, a strip of land 140 foot wide lying between the above tract and the right of way of the railroad company being the same strip conveyed to Guadalupe County for road purposes by Simon Anacker by deed dated January 2, 1913, recorded in Volume 39, page 410, Deed Records of Guadalupe County, Texas, said road having been abandoned. Said two parcels containing in the aggregate 92.25 acres of land, more or less. Except that 72 .4 acres contained in the original incorporation of the City of Cibolo in 1965. 1111 � 1111 411 SECTION II. The Mayor of the City of Cibolo is hereby authorized and directed to cause notice of such public hearing to be published once in a newspaper having general circulation in the city and inthe above described territory not more than twenty days nor less than ten days prior to the date of such public hearing, all in accordance with the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session, 1963; compiled as 970a, Vernon's Texas Civil Statutes.) SECTION III. The importance of this ordinance creates an emergency and an imperative public necessity that_ the rule requiring ordinances to be read at three several meetings be suspended, and this rule is hereby suspended, and the ordinance shall take effect and be in force from and after its adoption.
