ORD 235 05/19/1977 1111 • I ORDINANCE NO. 235 STATE OF TEXAS COUNTY OF GUADALUPE K CITY OF CIBOLO AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS, CREATING A PLANNING AND ZONING COMMISSION. SECTION 1 : CREATION AND PURPOSE A Planning and Zoning Commission is hereby created in order to accomplish the following purposes: A. To recognize community needs and to advise the City Council of their short-range and long-range implications for the total development of the city; A B. To recommend achievable community goals as a busis for long-range planning and development programs; C. To recommend plans, programs, and policies that will aid the entire community in achieving its defined goals; and D. To interpret the adopted plans and programs to concerned citizens so that private activities and desires may be accomplished in harmony with the public needs and policies. SECTION 2: MEMBERSHIP AND APPOINTMENT The Council shall appoint .a Planning and Zoning Commission consisteng of five (5) members who shall be residents of and own real property in the city, and shall serve without compensation. The City Council will_consider for appointment only those persons who have demonstrated a general knowledge of the community, independent judgement, interest in planning and zoning, and availability to prepare for and attend meetings. Members shall constitute a Commission which is broadly representative of the community. SECTION 3: TERMS OF OFFICE The terms of three (3) members shall expire, on October 1 of each odd- numbered year and the terms of two (2) of the members shall expire on October 1 of each even numbered year. The members of the Commission shall r_ be designated by place numbers one (1) through five (5) . The odd-num- bered places shall expire in the odd numbered years; the even-numbered places shall expire in even numbered years . Commission members may be appointed to succeed themselves . Vacancies shall be filled for unexpired terms, but no member shall be appointed for a term in excess of two years . SECTION 4: ORGANIZATION The Commission shall elect a chairman from its membership annually, and shall establish rules of procedure which shall include the following: A. A quorum shall consist of a majority of the membership and an affirmative vote of a majority of the membership shall be necessary to pass upon pending questions. lii1 1111. fr A 410 'S . 1 B. The chairman shall be entitled to vote upon any question. C. Minutes shall be kept of the proceedings of the Commission and shall be open to the public. D. All meetings shall be open to the public . SECTION 5: DUTIES AND POWERS The Planning and Zoning Commission is hereby charged with the duty and invested authority to: A. Make, ammend, extend, and add to a master plan for the physical develop- ment of the City; B. Be responsible to and act as an advisory body to the Council; C. Recommend to the Council approval or disapproval of proposed changes in the zoning plan; D. Review all plans for platting or sub-dividing of land within the City and within adjacent areas as permitted by law and submit finds and recom- mendations to the Council; E. Submit annually to the City Council, not less than ninety (90) days prior to the beginning of the fiscal year, a list of recommended capital improvements found necessary or desireable; F. Perform such other duties and be vested with such other powers as the Council may prescribe in accordance with the laws of the State of Texas . SECTION 6: COMMISSION ACTIONS A. A motion may be made by any member other than the presiding officer. B. A motion to approve any matter before the Commission or to recommend approval of any request requiring Council action shall require three (3) favorable votes of the members present. When fewer than all the members are present for the voting and when all motions to recommend' on a given application fail to carry by three (3) votes, consideration of the 'application shall be continued to the next regular meeting up- on motion carried by a majority of those present. Provided further that no request for application shall be continued under this rule beyond the next regular meeting; failure of the Commission to secure ,'. _ three (3) concurring votes to approve or recommend approval at said next regular meeting shall be recorded in the minutes as a denial of the proposal under this rule. SECTION 7: DISQUALIFICATION FROM VOTING A. A member shall disqualify himself from voting whenever he finds that he has a personal or monetary interest in the property under appeal, or that he will be directly affected by the decision of the Com- mission. om- mission. B. A member may disqualify himself from voting whenever any applicant, or his agent, has sought to influence the vote of the member on his application, other than in a public hearing.
