ORD 159 06/15/1974 n. • C/C of OrdiOnce- - - Ciof Cibolo • VOL 487 FAGS 564 • ORDINANCE NO. 159 AN ORDINANCE OF THE CITY OF CIBOLO, TEXAS, EXTENDING ITS EXTRATERRITORIAL JURISDICT IDN: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: WHEREAS the City of Cibolo has received a written request from Franklin E. Stolte Trustee and his wife Ruby E. Stolte owners of property contiguous to the extraterritorial jurisdiction of the City of Cibolo (a copy of which request is hereby attached and marked Exhibit "A" and made a part hereof as if the same were fully set out herein) ; and WHEREAS it is in the best interest of the City of Cibolo to include the property described in attached Exhibit •"A" in the extraterritorial jurisdiction of the City of Cibolo, Texas; IT IS THEREFORE ORDERED that the property described in attached Exhibit "A" be included in the extraterritorial jurisdiction of the City of Cibolo, Texas, and that the same rights and obligations applicable to all existing property with the extraterritorial jurisdiction of the City of Cibolo apply from this date on to the described property in attached Exhibit "A". Ling City :•cretary • • • VOL 487 FACE 565 STATE OF TEXAS: COUNTY OF GUADALUPE. • Request To Be Included In The Extraterritorial Jurisdiction Of The City Of Cibolo, Texas We, the undersigned, are the owners of that certain tract of land which is contiguous to the extraterritorial jurisdiction of the City of Cibolo, Texas, and which is described in Exhibit "A" a copy of which is attached hereto and made a part hereof as if the same were fully set out herein. We request that the property described in Exhibit "A" be included within the extraterritorial jurisdiction of the City of Cibolo, Texas, and that the City of Cibolo, Texas, extend its extraterritorial jurisdiction for all purposes over the property described in Exhibit "A" as provided in Art. 970A of the Revised Civil Statutes of the State of Texas. To the best of our knowledge and belief the property described in Exhibit "A" is not now within the extraterritorial Jurisdiction of any other City of the State of Texas. S • S • VOL 487 PAGE 566 EXHIBIT "A" All those certain tracts or parcels of land lying and being in the County of Guadalupe and State of Texas, and more fully described as follows: FIRST TRACT: Forty-Five (45) acres of land being a part of a 200 acre tract conveyed to Wm. Haecker by E. H. Stribling et al by deed dated April 10, 1871 , said 200 acres being a part of the J.M. Rosa Survey No. 86, and for metes and bounds is described as follows: BEGINNING at the S.W. corner of the 200 acre tract, from which a live oak, 18" in diameter bears S. 88° E. 9 varas; marked X; THENCE with thw S. E. line of the J.M. Rosa Survey North 60 deg. E 449 varas to the S.E. corner of said 200 acre tract; from which a Mesquite 8" in diameter bears S. 74 deg. E. 16 varas; THENCE with the boundary line of E. Haecker and this tract N. 30 deg. W. 500 varas, to a stake in the San Antonio Road; THENCE with said road S. 77 deg. W. 469 varas to a stake on the line between Wm. Haecker and Charles Haecker; THENCE with said line S. 30 deg. E . 631-6/10 varas to the beginning, containing forty-five acres, more or less. SECOND TRACT: Being fifty-five acres of land part of the Survey No. 63, granted to Wm. Backus, original of Jose Flores, and conveyed to Edward Stolte by Wm. F. Neubauer by deed dated, October 25, 1912, and recorded in Guadalupe County Records in Vol . 40 pages 12 & 13, and subject to the Vender 's line reserved in said deed. BEGINNING at the N.E. corner of the original Survey No. 63, for NE corner of this tract, which is also the N.W. corner of Gustav Claerner 's land; THENCE S. 60 deg. W. with the N.W. line of Survey No. 63 to a stake, 1240 varas from the beginning; THENCE S. 30 deg. E. 2502 varas to a stake the S.W. corner of this Survey; THENCE N. 60 deg. E. 1240 varas to a stake set in the public road, and N.E. line of Survey No. 63 for S.E. corner of thisstract; $HENCE N. 30 deg. W. with the N.E. line of Survey No. 63, 250-1/3 varas to the place of beginning, and being fifty-five acres of land. LESS AND EXCEPT thirty acres conveyed of to Franklin E.
