RES 1430 07/12/2011 �r OF c/,,, r0 • Y ''e x �S "City of Choice" RESOLUTION NO. 1730 A RESOLUTION SETTING THE CITY OF CIBOLO'S POLICY ON RECORDING EXECUTIVE SESSIONS AND ALLOWING CURRENT CITY COUNCIL MEMBERS TO REVIEW THE RECORDINGS WHEREAS, Texas Government Code Section 551.103 authorizes a governmental body to keep a certified agenda or tape recording of a closed meeting; and WHEREAS, Texas Government Code Section 551.103 excepts a governmental body from keeping a certified agenda or tape recording of closed meeting held under the authority of Texas Government Code Section 551.071 Consultation with an Attorney; and WHEREAS, the City Council of the City of Cibolo believes that all closed sessions, except for those held under the authority of Texas Government Code Section 551.071 Consultation with an Attorney, should be tape recorded; and WHEREAS, the Texas Attorney General has determined that it is not a violation of the Texas Open Meetings Act to allow a City Council Member to listen to a tape recording of a previously held closed session; and WHEREAS, the City Council of the City of Cibolo believes that policies should be adopted regarding the process for allowing a City Council Member to listen to a tape recording of a previously held closed session. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: The City Council for the City of Cibolo, after making such findings and determinations as listed above does hereby resolve that: 1. All closed sessions, except for those held under the authority of Texas Government Code Section 551.071 Consultation with an Attorney, should be tape recorded. 2. The attached Exhibit "A" shall be adopted as the policy for allowing a City Council Member to listen to a tape recording of a previously held closed session.
