RESOLUTION NO: 1523
A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE RESULTS
OF AN INITIATIVE ELECTION.
WHEREAS, on August 11, 2015, the City of Cibolo City Council ordered an election to be held
November 3, 2015 for the purpose of determining whether the resident, qualified voters of the
City of Cibolo would approve an Alcohol Initiative;
WHEREAS, the City Council has reviewed and investigated all matters pertaining to this
election, including the resolving, notices, election officers, holding, and returns thereof, and
WHEREAS, the City Council hereby canvasses the returns of this election, at which time there
was submitted to all resident, qualified voters of the City for their action thereupon, the
following proposition:
PROPOSITION
"AS AUTHORIZED BY Texas Alcoholic Beverage Code Section 109.33 (e), City
Council may consider application for variances to the prohibition against the sale of
alcoholic beverages within 300 feet of any church, private school or public school
only if City Council first conducts a public hearing on the matter and before the
thirtieth day before the date of the public hearing notice is given by: (i)publication
in the City's official newspaper; (ii)publication on the City's website; and (iii) letters
mailed to each owner of property, as shown on the City's most recent tax rolls, within
300 feet of the property for which the variance is sought."
WHEREAS, from these returns, this City Council hereby finds that the following votes were cast
in the election by voters who were resident, qualified voters of the City:

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CIBOLO, TEXAS THAT: Council officially finds, determines, and declares that the election
was duly and properly ordered, that proper legal notices of such election was duly given and that
a majority of the resident, qualified voters of the City of Cibolo, Texas voting in such election,
having voted FOR the Alcohol Initiative. City Council hereby finds and determines that the
Initiative passed at the November 3, 2015 Election.
