RES 1560 02/13/2018 J Of C/49 v r 0 y • r + � r TEXAS "City of Choice" RESOLUTION NO. ` SoO A RESOLUTION OF THE CITY OF CIBOLO, GUADALUPE COUNTY, TEXAS, CREATING A CHARTER REVIEW COMMISSION. WHEREAS, The City of Cibolo is a Home Rule Municipality located in Guadalupe County, Texas, created in accordance with provisions of the Texas Local Government Code and operating pursuant to its adopted City Charter and all applicable laws and enabling legislation of the State of Texas; and WHEREAS, The City of Cibolo City Charter establishes the authority and procedures for City Council to create, establish or appoint such boards, committees or commissions it deems necessary to carry out the functions and obligation of the City; and WHEREAS, The City of Cibolo desires to involve citizens in a way that effectively functions as a stakeholder group; and WHEREAS, The City of Cibolo The City Council feels it is important to receive community input and direction from the community to determine whether any provisions require revision; and WHEREAS, The City Council shall appoint a Charter Review Commission at least once every six (6) years and no more often than once every two (2) years to review and propose amendments to the City of Cibolo Charter. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: SECTION 1. CHARTER REVIEW COMMISSION CREATED SECTION 1.1 CREATION, COMPOSITION AND APPOINTMENT OF MEMBERS There is hereby created a Charter Review Commission to be composed of ten (10) members. One member will be nominated by each City Councilmember from citizens in their district that have filled out an application to serve on a City Committee or Commission, one member will be nominated by the Mayor and the two remaining positions are to be filled by one member from the Planning & Zoning Commission and one member from the Economic Development Corporation with no more than two 1 members from any district. All nominations will require a vote of the Council for placement on the committee. SECTION 1.2 QUALIFICATIONS AND TERMS OF MEMBERS Members of the Charter Review Commission shall be qualified voters and residents of the City of Cibolo. Members of the Commission shall be appointed to serve for not more than six months at which time a report shall be presented to the City Council and all records of proceedings of the Charter Review Commission shall be filed with the City Clerk and become a public record. All members shall serve at the pleasure of the City Council and may be removed at the discretion of the City Council. SECTION 1.3 DUTIES OF THE CHARTER REVIEW COMMISSION The Charter Review Commission will act as an advisory group to the Mayor and City Council and shall: • Inquire into the operation of the City government under the Charter and determine whether any provisions require revision; and • Propose any recommendations it deems desirable to insure compliance with the Charter of the City government; and • Report its findings and present its recommendation to the City Council. SECTION 1.4 ORGANIZATION AND MEETINGS The members of the Charter Review Commission shall elect a Chairman and Vice Chairman at their first meeting. All meetings will be held at Cibolo City Hall at 6:30 pm. Multiple meetings per month may be required of this commission. The commission will begin when members have been selected and appointed by City Council. The Chairman shall preside over the commission when in session and may vote on all matters. The vice chairman will preside in the absence of the chairman. SECTION 1.5 QUORUM A majority of the Charter Review Commission shall constitute a Quorum for the commission to meet and conduct business. SECTION 1.6 RULES AND PROCEDURES; RECORD OF PROCEEDINGS The Charter Review Commission will follow the Rules and Procedures as provided in the City Council Policy. The City Secretary or her designated representative shall take minutes, record each session and post agendas as required. SECTION 1.7 COMPENSATION The Charter Review Commission shall serve without compensation. 2 APPROVED AND ADOPTED by a vote of "7 for to _Q5 against this 13 th day of , 2018.
