RES 1495 09/09/2014 OF C 40 C is 0 « ex 5 RESOLUTION No. 1495 A RESOLUTION TO ADOPT A POLICY ON PROCESSING ZONING APPLICATIONS WHICH REQUIRE A ZONING CHANGE FROM A COMMERCIAL OR INDUSTRIAL DESIGNATION TO A RESIDENTIAL ZONING DESIGNATION ON PROPERTY ADJOINING F.M. 1103. WHEREAS, F.M. 1103 is a major roadway and essential to the flow of persons living in the City of Cibolo, and WHEREAS, the City of Cibolo has a common interest in the safety and welfare of residents of the F.M. 1103 area, and WHEREAS, the City of Cibolo agrees that the public safety will be improved by consistent standards of zoning regulation throughout the area and their combined enforcement of those standards, and WHEREAS, the City of Cibolo would not process zoning applications that would request a zoning change, from a commercial or industrial designation to a residential zoning designation on property adjoining F.M. 1103, and WHEREAS, all rezoning amendments proposed along F.M. 1103 must be in accordance with the most current Future Land Use Plan, and WHEREAS, the City of Cibolo may desire at times to support down-zoning of a commercial piece of property, to include a combination of commercial and residential development or a PUD, and WHEREAS, the City of Cibolo will require the commercially zoned portion of the property to be constructed concurrently with 50% of residential home starts, and WHEREAS, the City will require that the commercial or industrial zoned portions of the property be ready for business prior to development of the remaining 50% of the residentially zoned portion of the property, and WHEREAS, the City Council wants to ensure developments which require access or use F.M. 1103 that the development provide for sidewalks and when required or necessary acceleration and deceleration lanes and traffic signals, and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS; THAT the City Council strongly supports the above position to improve transportation mobility and zoning along F.M. 1103. The Cibolo City Council adopts this position and directs the Planning and Zoning Commission and City Staff to adhere to said resolution. APPROVED AND ADOPTED ON THIS �1 DAY OF— se,� �H-,�f,,. , 2014.
