RES 1485 02/25/2014 o �" c�� 0 r o T£ X Pte' "City of("hoir("" RESOLUTION NO. 1, 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS, AUTHORIZING THE MAYOR, COUNCIL MEMBERS AND CITY STAFF TO REQUEST AN INVESTIGATION INTO ANY CRIMINAL MISCONDUCT BY FORMER AND CURRENT MEMBERS OF CITY COUNCIL AND CITY STAFF OR OTHERS AND RELATED ISSUES ASSOCIATED WITH THE WAL-MART DEVELOPMENT PROJECT OR OTHER ASSOCIATED ISSUES WHEREAS, the City Council of the City of Cibolo convened in an open meeting on February 11, 2014 and during said meeting discussion was held on whether the City Council should authorize a third party to conduct a formal investigation of the application process and related issues associated with the Wal-Mart Development Project and any other misconduct by the City's former and current Mayor and City Council as well as former and current City Staff, or others; and WHEREAS, as a result ofthis discussion, a motion was made by Councilman Garrett and seconded by Councilman Pedde to authorize said investigation but that in particular, the Council wanted the Texas Rangers to handle said investigation to ensure it was conducted impartially and thoroughly; and WHEREAS,it is the intent of the City Council of the City of Cibolo to have a third party, and in particular the Texas Rangers, if possible, to investigate the conduct of former and current City Council members, city staff and others in relation to the Wal-Mart Development Project so that all facts pertinent to the zoning, site plan approval and other administrative procedures followed by the former Council and City staff in connection therewith are analyzed to determine whether any criminal misconduct, malfeasance or wrongdoing took place. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO,TEXAS: SECTION 1. That the City Council hereby authorizes and requests that Council Members Garrett, Hogue and Carlton get with Police Chief Cox to work with the District Page 1 of 2 Attorney's Office to see if the Texas Rangers would conduct an investigation into any criminal misconduct by either the mayor, council, staff or others in the application process and related issues associated with the Wal-Mart Development Project. PASSED, APPROVED, AND ADOPTED on this 25th day of February, 2014 at a regular meeting of the City Council of the City of Cibolo, Texas, which meeting was held in compliance with the Open Meetings Act, Tex. Gov't Code, §551.001, et.seq. at which meeting a quorum was present and voting. Lisa M.
