ORD 1231 04/10/2018 S OFCf4 7 C tt a 4 ORDINANCE NO. 1a3I AN ORDINANCE BY THF CITY COUNCIL OF THE CITY OF CIBOLO, GUADALUPE COUNTY, TEXAS, PROVIDING FOR THE FIFTH AMENDMENT OF THE BUDGET FOR THE FISCAL YEAR 2017-2018, BEGINNING OCTOBER 1, 2017, AND ENDING SEPTEMBER 30, 2018; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE OF ALL OTHER ORDINANCES OF THE CITY OF CIBOLO; PROVIDING FOR SEVERABILITY; PROVIDING SAVINGS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Cibolo, Guadalupe County, Texas, passed and approved Ordinance Number 1209 on September 12, 2017, and thereby adopted the Fiscal Year 2017-2018 Annual Budget; and WHEREAS, the City Council of the municipality of Cibolo, Guadalupe County, Texas, may amend the budget from time to time; WHEREAS, it is necessary, at this time, to make the fifth amendment to the Fiscal Year 2017- 2018 Annual Budget to increase expenditures accordingly for the fiscal year. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: SECTION 1. INCORPORATION That the above and foregoing premises are true and correct and are incorporated herein and made part hereof for all purposes. SECTION 2. ADOPTION That the approved and adopted budget for Fiscal Year 2017-2018, is hereby amended as specified in Exhibit A attached hereto. SECTION 3. CUMULATIVE CLAUSE That this ordinance shall be cumulative of all provisions of the City of Cibolo,Texas,except where the provisions of this Ordinance are in direct conflict with the provisions of such Ordinances, in which event the more restrictive provision shall apply. SECTION 4. SEVERABILITY That it is hereby declared to be the intention of the City Council of the City of Cibolo that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance should be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,paragraphs or sections of this Ordinance, since the same would have been enacted by the City Council without incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. SAVINGS That all rights and privileges of the City of Cibolo are expressly saved as to any and all violations of the provisions of any Ordinances affecting the annual budget for Fiscal Year 2017-2018,which have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 6. EFFECTIVE DATE That this Ordinance shall be effective immediately upon the passage and approval of the City Council of the City of Cibolo, Texas, and it is so ordained. Once the below scope is completed the City will have a plan by which the eventual repair,reconstruction, and ordinary maintenance of the City's roadways can be accomodated. _ SERVICES TO BE PERFORMED BY ENGINEER: • ENGINEER will develop a map of the City with the number of lanes for each segment identified thematically; • ENGINEER will work with City staff to identify streets that have an age of 5-years or less and exclude those from the scope of field data collection; • ENGINEER will work with City to determine the scope of the field data collection up to the limit of 250 lane miles based on a reasonable priority assignment; • ENGINEER will obtain the services of Fugro USA Land, Inc. (Fugro) to perform automated data collection for 250 lane miles of roadway to include the following: o Inventory the quantity and road classification for roadway segments to be included in the study; o Collect pavement surface distress and structural condition information using automated laser road surface testing equipment. o Develop Pavement Condition Index (PC]) for agreed to road segments using the methodology as described in ASTM D 6433. • ENGINEER will develop criteria in coordination with City to establish PCIs which will qualify for repair,rehabilitation, or replacement; • ENGINEER will utilize the information collected to select appropriate street repair, rehabilitation or replacement strategy for each street segment and prepare an estimate of the cost for the proposed strategy based on the PCI collected; • ENGINEER will create shape (.shp) files for roadway data for incorporation into the City GIS system; • ENGINEER will develop a priority list for projects that maximize the value of the annual investment made by the City into the plan; • ENGINEER will produce exhibits by plan year showing the segments requiring rehabilitation or reconstruction; • ENGINEER will make recommendations for"good housekeeping"maintenance to extend the life of existing pavements; • ENGINEER will produce a DRAFT Pavement Management Plan Report with recommendations for a 5-year plan to achieve a reasonable city-wide average PCI; • ENGINEER will produce a FINAL Pavement Management Plan Report after addressing City comments; ASSUMPTIONS USED IN DETERIMING SCOPE OF SERVICES: • N/A C.•\Users\j'mmurray\Doniments\FY 18 Crbalo Tark Orderr\TO 18-03 ATTACHMENT A tka.< 1 DELIVERABLES: Meeting minutes ESRI Shapefiles Pavement Condition Survey(Fugro) DRAFT Pavement Management Plan Report FINAL Pavement Management Plan Report BILLING METHOD: Lump Sum FEE:$126,368.00 SCHEDULE FOR PERFORMANCE OF THE WORK: 180 Days following notice-to- proceed.
