ORD 1229 03/27/2018 • y OF C1 �. 11144:� . . xs ORDINANCE NO._all AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF CIBOLO, GUADALUPE COUNTY, TEXAS, PROVIDING FOR THE FOURTH AMENDMENT OF THE BUDGET FOR THE FISCAL YEAR 2017-2018, BEGINNING OCTOBER 1, 2017, AND ENDING SEPTEMBER 30, 2018; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE OF ALL OTHER ORDINANCES OF THE CITY OF CIBOLO; PROVIDING FOR SEVERABILITY; PROVIDING SAVINGS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Cibolo, Guadalupe County, Texas, passed and approved Ordinance Number 1209 on September 12, 2017, and thereby adopted the Fiscal Year 2017-2018 Annual Budget; and WHEREAS, the City Council of the municipality of Cibolo, Guadalupe County, Texas, may amend the budget from time to time; WHEREAS, it is necessary, at this time, to make the fourth amendment to the Fiscal Year 2017- 2018 Annual Budget to increase expenditures accordingly for the fiscal year. NOW THEREFORE BE IT ORDAINED BY TH H; CITY COUNCIL OF THE CITY OF CIBOLO,TEXAS: SECTION 1. INCORPORATION That the above and foregoing premises are true and correct and are incorporated herein and made part hereof for all purposes. SECTION 2. ADOPTION That the approved and adopted budget for Fiscal Year 2017-2018, is hereby amended as specified in Exhibit A attached hereto. • ® SECTION 3. CUMULATIVE CLAUSE That this ordinance shall be cumulative of all provisions of the City of Cibolo,Texas,except where the provisions of this Ordinance are in direct conflict with the provisions of such Ordinances, in which event the more restrictive provision shall apply. SECTION 4. SEVERABILITY That it is hereby declared to be the intention of the City Council of the City of Cibolo that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance should be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,paragraphs or sections of this Ordinance, since the same would have been enacted by the City Council without incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. SAVINGS That all rights and privileges of the City of Cibolo are expressly saved as to any and all violations • of the provisions of any Ordinances affecting the annual budget for Fiscal Year 2017-2018,which have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 6. EFFECTIVE DATE That this Ordinance shall be effective immediately upon the passage and approval of the City Council of the City of Cibolo, Texas, and it is so ordained. Herrera City Manager City of Cibolo From: Roger D.Niemietz Fire Chief City of Cibolo Re: Emergency Repair of Engine 20—Ferrara Fire Truck—Station 2 Mr. Herrera, Engine 20, a 2011 Ferrara Intruder 2 fire truck is currently out-of-service with engine failure. The fire truck is at Grande Truck Center in San Antonio, Texas. In order to get an estimate for repairs, Grande had to dis-assemble the engine in order to identify the ptoblern(s). 1. Diesel Engine—Failure—Re-build engine • 2. Brake work 3. Check Transmission All fire trucks are check on a daily basis, i.e. fluids, tires, pumps and equipment. Engine 20 is out of warranty with 41,957 miles, 7 years old and ran over 4,000 calls for service. I am confident with re-building the diesel engine and while in the shop,mechanics will perform brake work and check the Allison automatic transmission,Engine 20 should have an estimated sustainable life of 10 to 15 years. This is an unfortunate situation in which a diesel engine has failed in a fire truck. The estimate to totally repair E20 is $35,000.00. This is approximately 8%to 10% of the total vehicle cost. I have given Grande Truck Center the approval for emergency repair. I am respectfully asking for a City Council approved budget amendment through Finance. Current Fire Department budget does not have the funds required to pay for,the repairs. pectfully, D 4111 11Page
