RESOLUTION NO. 14 81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS, ACCEPTING A DEDICATION OF A 23 FOOT (OR 0.653 OF AN ACRE) RIGHT-OF-WAY MADE BY DEVELOPER/OWNER BLANTON FAMILY LIMITED PARTNERSHIP PERRY BLANTON IN CONNECTION WITH THE CONSTRUCTION OF THE PRIVATE DEVELOPMENT KNOWN AS "TURNING STONE" ("THE PROJECT") WHEREAS, Section 20.3.6 of the Cibolo Unified Development Code provides that a final subdivision plat submitted for approval by the City shall demonstrate compliance with certain requirements of the code including the dedication of streets, public areas, easements or parks which shall be accepted by the city upon the authorization of the City Engineer; and WHEREAS, the Blanton Family Limited Partnership, by and through Mr. Perry Blanton ("owner"), has formally dedicated a 23 foot (0.653 acre) right— of— way for the City's use as a public right-of-way, the location of public utilities and the construction, use and maintenance of storm water drainage facilities in connection with the owner's residential subdivision development project which will be located along the north side of Green Valley Road between the western boundary of the development known as Turning Stone and the western right-of-way boundary of FM 1103, as more particularly described in the instrument recorded in Volume 4154 Page 0455-0461 of the Official Records of Guadalupe Countyin the City of Cibolo as required by the City's Unified Development Code; and WHEREAS, based on the approval of the City Engineer that the owner has met all requirements of the Unified Development Code with respect to the dedication of right-of-way as reflected herein to satisfy the purposes set forth in the Coderelating to the City's provision of public works services and capital improvements within the above described subdivision the City hereby finds that said right-of-way dedication shall be accepted and that acceptance of this dedication is in the City's best interest. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO,TEXAS: Resolution No. Page 1 of 2 SECTION 1. That the City Council of Cibolo accepts the dedication of the right-of-way made by the Blanton Family Limited Partnership to the City a description of said property is fully set forth in the attached Exhibit "A" for the purposes provided therein and as stated in the City's Unified Development Code. SECTION 2. The City Engineer is hereby authorized to execute the dedication instrument and all related documents on behalf of the City to formalize this acceptance. PASSED, APPROVED, AND ADOPTED on this 10"'day of December, 2013, at a regular meeting of the City Council of the City of Cibolo, Texas, which meeting was held in compliance with the Open Meetings Act, Tex.
