RES 1473 07/09/2013 or C/i& Q r O re X As -(.31y o] ("hoice" RESOLUTION NO. 14 7 3 A RESOLUTION ADOPTING AN ORDER SETTING THE TIME, DATE AND LOCATION OF A PUBLIC HEARING FOR THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS TO SOLICIT COMMENTS AND TESTIMONY FROM ANY MEMBER OF THE PUBLIC REGARDING AMENDMENTS TO THE CITY OF CIBOLO WATER, WASTEWATER, DRAINAGE AND TRANPORATION IMPACT FEE PROGRAMS BY ADOPTING UPDATED LAND USE ASSUMPTIONS, ADOPTING AN UPDATED CAPITAL IMPROVEMENTS PLAN; REVISING THE IMPACT FEE SERVICE AREA BOUNDARIES AND ADOPTING A WATER IMPACT FEE STUDY, A WASTERWATER IMPACT FEE STUDY, A DRAINAGE IMPACT FEE STUDY AND A TRANSPORTATION IMPACT FEE STUDY; AND BY AMENDING THE WATER, WASTEWATER, DRAINAGE AND TRANSPORTATION IMPACT FEES TO BE CHARGED BY THE CITY OF CIBOLO. WHEREAS, the City has caused its existing Land Use Assumptions, Impact Fee Service Area and 5-Year 2013-2017 Capital Improvements Plan to be reviewed by the Capital Improvements Plan Advisory Committee on April 10, 2013, and reviewed by City Council on April 23, 2013 and on May 20, 2013; and WHEREAS, the City has caused its existing Land Use Assumptions, Impact Fee Service Area and 5-Year 2013-2017 Capital Improvements Plan to be reviewed, evaluated and updated by qualified professionals using generally accepted engineering and planning practices in accordance with the provisions of Subchapter B of Chapter 395 of the Texas Local Government Code; and WHEREAS, such updates to the Land Use Assumptions, Impact Fee Service Area and 5- Year 2013-2017 Capital Improvements Plan necessitate an increase in the water, wastewater, drainage and transportation impact fees in order to implement and fund the expenses of constructing capital improvements and facility expansions in accordance with the provisions of Chapter 395 of the Texas Local Government Code; and WHEREAS, the City's consultants have prepared the following; (i) City of Cibolo Water System Master Plan Impact Fee Study, dated July 1, 2013; (ii) City of Cibolo Wastewater System Master Plan Impact Fee Study, dated July 1, 2013; (iii) City of Cibolo Drainage Page 1 System Master Plan Impact Fee Study dated July 1, 2013; and (iv) City of Cibolo Transportation System Master Plan Impact Fee Study dated July 1, 2013; and WHEREAS, The City of Cibolo ("City") intends to fully comply with Chapter 395, Texas Local Government Code, with regards to notice, adoption, promulgation and methodology as required for creation and adoption of the updated Land Use Assumptions, Impact Fee Service Area and 5-Year 2013-2017 Cibolo Capital Improvements Plan. NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: Section 1. Order of Public Hearing. The City Council hereby orders a public hearing to be conducted on August 13, 2013, at 7:00 p.m., at City Hall of the City of Cibolo, for the expressed purpose to consider amendments to the Land Use Assumptions, 2013-2017 Capital Improvements Plan, and the imposition of water, wastewater, drainage, and transportation impact fees; in accordance with Section 395.055 of the Texas Local Government Code. Section 2.Notice of Public Hearing. City Council herby authorizes the publication of a "Notice of Public Hearing on Amendment of Impact Fees" pursuant to the requirements of the Texas Local Government Code Chapter 395.
