RESOLUTION NO. 1467
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS,
EXPRESSING SUPPORT FOR STATE LEGISLATION ON CONSUMER
PROTECTION FOR BUYERS OF NEW HOMES.
WHEREAS, the City of Cibolo desires that homebuyers have safe and healthy homes; and
the homebuyers have made the largest financial investments of their lives in safe
and healthy homes; and
WHEREAS, the City of Cibolo believes homebuyers should be assured their investments are
protected from unsafe and unhealthy constructions practices; and
WHEREAS, the home builder promulgates the safety and health of the house to the
homebuyer through a risk retention group warranty, not regulated by the State of
Texas; and a warranty that obligates the homeowner to binding arbitration, and a
warranty that denies the homebuyer due process; and
WHEREAS, the City of Cibolo believes the homebuilders deserve a fair return on their
investment and should strive to build a quality product and should stand behind
their product and be given a reasonable number of opportunities to correct
defects in their products; and
WHEREAS, homebuilders at times have not been responsive with timely or quality repairs,
and have used unenforceable warranties to deny responsibility for flawed
construction, and have required expensive and time consuming binding
arbitration, which 96% of the time has favored the homebuilder; and
WHEREAS, the City of Cibolo recognizes that quality homes are essential to maintaining
good growth, quality communities and long term fiscal stability to the City, County
and School District's tax rolls and poorly constructed homes decrease values and
lead to declining tax base; and
WHEREAS, the City of Cibolo recognizes that quality constructed homes are important to
acquiring and maintaining businesses, industries and an expanding economic
base; and
WHEREAS, the City of Cibolo fully supports the goals of the Texas State Legislature in its
efforts to protect Homebuyers of Texas from poor quality constructed homes;
WHEREAS, the Home Buyer Protection Act, or any other legislation supporting the protection
of homeowners, if approved by the Texas Legislature will provide additional
protection to all new home buyers in Texas from poorly constructed homes;
NOW, THEREFORE, BE IT RESOLVED that the City of Cibolo respectfully requests that the
State Legislature and the Governor of Texas pass legislation which protects new home buyers.
