Call to Order-Mayor Jennifer Hartman called the meeting to order at 7:00pm. 2. Pledge of Allegiance-All stood for the pledge of allegiance. 5. Citizens to be Heard This is the opportunity for visitors and guests to address the City Council on any issue. City Council may not debate any non-agenda issue,nor may any action be taken on any non-agenda issue at this time,however,City Council may present any factual response to items brought up by citizens. Suspension of Rules: Mayor Jennifer Hartman suspended the rules so South Texas Children's Pediatric Care could be introduced to City Council. Dr Diana Burns, Dr. Daniel Trevino and Dr. Linda Holly are the partners for this business venture. Dr. Diana Burns thanked the audience for the warm welcome. The doctors with the STCPC group hope to expand services to possibly include, a pharmacy,lab office and other medical services. 6. Public Hearing The City of Cibolo City Council will hold a public hearing to hear public testimony regarding the City of Cibolo Capital Improvements Plan relating to the possible adoption of impact fees. The purpose of the hearing is to consider the land use assumptions and capital improvements plan under which an impact fee may be imposed. Mayor Jennifer Hartman opened the public hearing at 7:07 pm.Robert Stricker went over the process of the CIP Improvements Plan.There were no citizens to speak at this public hearing.Mayor Jennifer Hartman closed the Public Hearing at 7:12 pm. 1 7. Consent Agenda A. Approval of the minutes of the Regular City Council Meeting held on August 14,2012. B. Approval of the minutes of the Council Workshop held on August 21, 2012. C. Acceptance of the Revenue and Expense Report ending July 31,2012,pending final acceptance of the City's financial audit for the 2011/2012 Fiscal Year. D. Acceptance of the July 31, 2012 Check Register pending final acceptance of the City's financial audit for the 2011/2012 Fiscal Year. E. Approval of the Preliminary/Final Plat of Kids R Kids-STCPC. Councilman Melvin Hicks asked for Item C to be pulled from the Consent Agenda. Councilman Miguel Troncoso made a motion to approve Item A,B,D and E. Councilman Ron Pedde seconded the motion. Councilman Ron Pedde, Councilman Miguel Troncoso, Councilman Gabriel Castro, Councilwoman Karen Hale, Councilman Larry Carlton,Mayor Pro-Tem Steve Liparoto and Councilman Melvin Hicks all in favor, none opposed.Motion passed 7 to 0. Councilman Melvin Hicks asked the Finance Director Anna Marquez about the Multi-Event Stadium rental expense line.Anna Marquez explained the line was not needed and removed. Revenue from the Multi-Event Stadium is approx. $11,000.00. Councilman Gabriel Castro made a motion to accept Item C-Revenue and Expense Report ending July 31,2012. Councilman Miguel Troncoso seconded the motion. Councilman Ron Pedde, Councilman Miguel Troncoso,Councilman Gabriel Castro, Councilwoman Karen Hale,Councilman Larry Carlton and Mayor Pro-Tem Steve Liparoto all in favor. Councilman Melvin Hicks opposed. Motion passed 6-1. 8. Staff Updates A. Capital Project Schedule B. Police Department C. Utility Department D. Street Department E. Parks Department F. Drainage Utility F. Administration Public Works Director Tim Fousse spoke on three items.Item 1: Enterprise Products is working and repairing the 20"gas line that runs through Cibolo.They are keeping the City informed of their status regularly.Item 2:West Nile Virus has many concerned.Fire Chief Roger Niemietz will be attending a meeting this week in San Antonio on the subject.The City will work to identify the problem areas and treat them.Item 3:Tim Fousse announced the City just received the 2012 Box Work Van.This new equipment has a sewer camera which will help the City inspect and repair water/wastewater lines more efficiently. 2 9. Discussion/Action A. Discussion/Action on the removal, appointments and re-appointments to Planning and Zoning Commission, Parks Commission, Streets and Drainage Commission,Board of Adjustments Commission,Capital Improvement Program(CIP), Cibolo Economic Development Corporation and UDC Committee and/or other advisory boards or commissions as necessary. Councilman Melvin Hicks made a motion to appoint Shannon Wright to the Parks and Recreation Commission. Councilman Larry Carlton seconded the motion. Councilman Ron Pedde, Councilman Miguel Troncoso,Councilman Gabriel Castro, Councilwoman Karen Hale, Councilman Larry Carlton, Mayor Pro- Tem Steve Liparoto and Councilman Melvin Hicks all in favor,none opposed. Motion passed 7 to 0. B. Discussion/Action on the disannexation of 123.4 acres of land being west of Haeckerville Rd,south of DW Lane,north of Bolton Rd and East of the Cibolo Creek. Owner:William and John Chadwell. Randal Anderson spoke to the City Council the unusual circumstances of this disannexation request.Mr. Chadwell never received his certified letters of notification.He is employed as a long haul truck driver.His job requires him to be away from home. The City proceeded with the annexation legally. City Council asked that some of the dates on the annexation agreement be corrected.The dates on the agreement should match the dates on the ordinance. Staff will make the corrections that Council requested. Mayor Pro-Tem Steve Liparoto made a motion to approve the disannexation.Councilman Larry Carlton seconded the motion. Councilman Ron Pedde, Councilman Miguel Troncoso,Councilman Gabriel Castro,Councilwoman Karen Hale,Councilman Larry Carlton and Mayor Pro-Tem Steve Liparoto all in favor. Councilman Melvin Hicks opposed. Motion passed 6-1. C. Discussion/Action of memorializing an updated City of Cibolo City Limits/ETJ Map if the disannexation of 123.4 acres of land being west of Haeckerville Rd,south of DW Lane,north of Bolton Rd and East of the Cibolo Creek owned by William and John Chadwell is approved.This new updated map will reflect the approved disannexation. Councilman Miguel Troncoso made a motion to approve the memorializing the updated City of Cibolo City Limits/ETJ Map.Mayor Pro-Tem Steve Liparoto seconded the motion. D. Discussion/Action on the acceptance of the Dean Tract Land Study subject to the Planning and Zoning recommendations. Randal Anderson informed the City Council that the City Engineer recommends acceptance with four stipulations. 1. A Traffic Impact Analysis. 2.A Rough Proportionality Analysis assessing City and Developer obligations and responsibilities. 3.An Engineering Plan demonstrating the redevelopment and or reuse of existing Green Valley Road ROW behind Charleston Park Unit 2.4.A detailed Stormwater Management Plan.There is a 5`h stipulation pertaining to approval of a utility plan. Councilman Gabriel Castro made a motion on the acceptance of the Dean Tract Land Study with the additional stipulation than the preliminary plat shows Town Creek Rd connecting to Green Valley Rd per the Future Thorough Plan.Councilwoman Karen Hale seconded the motion. Motion passed 7 to 0. E. Discussion/Action on the report from City Staff concerning the lawn maintenance of 104 Cinnabar Trail. Robert Stricker updated the City Council that the lawn maintenance of 104 Cinnabar Trail has been resolved. The lawn was mowed on Aug.21 or 22,2012.Resident Pat Youngblood who brought issue to City Council was satisfied with the results. 3 F. Discussion/Action on the report from City Staff concerning the rodent infestation around Navajo Circle and Buffalo Trail. Robert Stricker updated the City Council on the rodent infestation around Navajo Circle and Buffalo Trail. The City sent letters out to the residents in this neighborhood asking for community involvement to clean up areas that might house the rodents. Code Enforcement Officer Guy Hart worked with the neighbors and that area has been cleaned up and the residents are happy. G. Discussion/Action/Recommendation to staff on organizing a selection committee to choose a recipient for the 2012 Gary Kelly Community Service Award. Mayor Jennifer Hartman suggested that three individuals are selected to be on the Gary Kelly Community Service Award nomination committee.The City Council suggested that the last two recipients be on the committee.They asked City Secretary to notify Bob Catalano and Tex Farnsworth and ask if they would be on the nomination committee. H. Discussion/Action on the review and confirmation of all upcoming special meetings and workshops and scheduling the time,date, and place of additional special meetings or workshops. Executive Session The City Council will meet in Executive Session as authorized by the Texas Gov't Code Sec. 551.071 Consultation with Attorney to discuss the following litigation: A. Shelby Koehler vs. City of Cibolo Mayor Jennifer Hartman called the Executive Session at 8:37 pm. 12. Open Session Reconvene into Regular Session and take action/or give direction,if necessary,on items discussed in Executive Session. 4 Mayor Hartman reconvened into Regular Session at 9:10 pm. 13. City Council request(s)regarding specific items or staff reports to be scheduled for future agendas. 14. Adjournment Councilman Gabriel Castro made a motion to adjourn the meeting.
