ORD 372 04/01/1986 ORDINANCE NO. 372 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS, PROHIBITING COMMERCIAL VEHICLES FROM PARKING ON PUBLIC STREETS AND RIGHT OF WAYS, WITH THE EXCEPTION OF VEHICLES MAKING DELIVERIES WITHIN THE CITY, AND PROVIDING FOR A PENALTY FOR VIOLATION HEREOF. WHEREAS, the City Council of the City of Cibolo is charged with the duty of providing for the safety of both the traveling public and the citizens of Cibolo within the corporate limits of the City of Cibolo; and WHEREAS, the City Council of the City of Cibolo is charged with the duty of maintaining all public streets and right of ways within the corporate limits of the City of Cibolo; and WHEREAS, the parking of commercial vehicles on the public streets and right of ways of Cibolo, Texas , causes street deteriora- tion due to excessive weight, traffic congestion, impedes the orderly passage and flow of traffic, and further serves to obstruct the view of operators of motor vehicles driving same on the public streets within the corporate limits of the City of Cibolo, Texas; NOW THERE- FORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS, THAT: SECTION 1. It shall be unlawful for any operator or driver of any commercial vehicle as hereafter defined, to park, leave standing or store said vehicle on a public street or right of way within the corporate limits of the City of Cibolo, Texas . Commercial vehicles for the purpose of this ordinance is defined to include trucks and/or trailers which exceed 12 , 000 lbs . axle weight . This does not apply to public transportation. SECTION 2 . It shall be unlawful for any person, firm or corporation directly or through an agent , servant or employee, to use or permit to be used for through truck traffic, as hereinafter defined, any street within the City of Cibolo. As used herein, the following terms have the meanings indicated below: Commercial Vehicle - To include trucks and/or trailers which exceed 12, 000 lbs axle weight . This does not apply to public transportation. Through Truck Traffic - The driving or operation of a truck on a street or alleyway, unless the person driving or operating such truck has occasion to and does bring such truck to a stop at some point, place or location upon the street or alleyway within the corporate limits of the City of Cibolo for the pur- pose of loading or unloading such truck, or for the purpose of rendering a service at such point , place or location in connec- tion with the business for which such truck is used. SECTION 3 . Any person who shall violate any provisions of this ordinance shall be deemed to be guilty of a misdemeanor, and shall upon conviction be punished by a fine not to exceed One Thousand Dollars ( $1000 ) .
