I ORDINANCE NUMBER - 42 AN ORDINANCE ANNEXING THE HEREINAn.bR DESCRIBED 'TERRITORY TO THE CITY ' OF CIBOLO, 'TEXAS AND EXTENDING THE BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE. SUCH PROPERTY WITHIN THE CITY LIMITS. WHEREAS, a petition for annexation has been heretofore filed by Mr. Louis Kowalski, being the owner of certain land in, the extraterritoral jurisdiction of the City of Cibolo, Guadalupe ,County, Texas, said land being described in Paragraph 1 below; and WHEREAS, said petition is proper in form and substance and fully complies ' with all of the provisions of Art. 974g, V.A.T.S.; and . WHEREAS, a public hearing has been held; and WHEREAS_ , said tract of land is contiguous and adjacent to the City of Cibolo, and is not more than one-half mile in width; and WHEREAS, the City Council is of the opinion. that said petition should be granted and that said. tract of land should be annexed to the City; NOR THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: 1. That the following described property, to wit: A 198.114 acre tract being out of 205 acres out of the Doroteo Hernandez Survey No. 76, Abstract No. 164, conveyed by Adam Kneupper and Wife to Ernest Kneupper by deed dated May 23, 1912, and 'recorded May 19, 1914 in Volume 41, Page 639 of the Deed Records of Guadalupe County, Texas; said 198.114 acre tract being more particularly described- ' escribed' as follows: BEGINNING at a found monument on a fence corner at the easterly -end of a cut- -off line at the intersection of the east right of way line of F.M. Road 3009 with the north line of Dietz Road;' THENCE N 64° 59' 46" W, 69.79 feet along said cut-off line .with fence to a foun. monument at a fence corner; THENCE, the following calls_ alonga fence and the east right of .way line of F.M. Road 3009: N -30° 29° 18" W, 929.99, feet to a fence .post for an interior corner; N -35° 33' 13" W., 200.88 feet to a fence post; N 30° 31' 42" W, 1128.50 feet to a found iron pin at a fence corner for the most westerly corner of this tract; THENCE N 60° 04' 00" E, 3741.49 feet leaving said east right of way line along a fence and the canton line between this tract and a 200.597 acre tract described in Volume 454, Page 274 'to a found iron pin at a fence corner on the easterly line. of the Doroteo Hernandez Survey No. 76 for the most northerly corner of this tract; THENCE S 30° 56' 00" E, 2297.10 feet along a fence and said easterly survey line, to a fence corner post on the north line of the Simon Cockrill Survey No. 77 for the most easterly corner of this tract, being also the -most easterly corner of said Doroteo Hernandez Survey -No 76; f i i . , • ' VUL '%-mo • tog THENCE, the following calls, along a fence and the cannon line between the Doroteo Hernandez Survey No. 76 and Simon Cockrill Survey No. 77: S 59° 50' 36" W, 530.03 feet to a found iron pin at a fence corner; S 59° 53' 21" W, 411.53 feet to a found iron pin at a fence corner; S 59° 28' 16" W, 1783.58 feet to- a found iron pin at a fence corner on the easterly line of Dietz Road; THENCE N 36° 36' 13" W, 14.70 feet along a fence and said east line to a fence corner post on the northerly line ofiDietz Road; THENCE S 59° 23' 48" W, 974.40 feet along a fence and said north line, to the point of BEGINNING and containing 198.114 acres of land. BE, and the same is hereby annexed to the City of Cibblo, and that the boundary lines of the City of Cibolo be, and the same are -hereby extended to include the above described territory within the city limits of the City of Cibolo, Texas, and the same shall hereafter be included.,within the territorial limits of said city, and the. property owners and inhabitants thereof shall hereafter be entitled to all rights and privileges Of other property owners and citizens of Cibolo, and shall be bound by the acts, Ordinances, .and regulations of said City. 2. The City Secretary is hereby directed to file a certified' copy of this ordinance with the County Clerk of Guadalupe County, Texas, 3. Th: undersigned owners of the hereinafter described tract of land, which is vacant and without residents, or on which less than three (3) qualified voters reside, hereby petition your Honorable Body to extend the present city limits so as to include as a part of the City of Cibolo, Texas the following territory as described in exhibit_,"A", a copy of which is attached hereto and made a part hereof as if the land were fully set out herein. Loop 410, Suite 706 San Antonio, Tx 78123 Subject: Annexation Service Plan Dear Mr. Kowalski: Upon completion of the annexation of 198.114 acres of land owned by you, which you have petitioned to the City for annexation, the City of Cibolo hereby provides the following service plan for the land being annexed into the corporate limits of the City of Cibolo, Texas. 1. Police: Radio response to calls, and other equipment, will be provided on and after the effective date of annexation. Traffic signs, street markers, and other traffic control devises will be installed as the need thereof is established by appropriate study and traffic requirements. 2. Fire: Fire protection by the present personnel and equipment of the fire fighting force of the Cibolo Volunteer Fire Department, within the limita- tions of the available water, will be provided on and after the effective date of annexation. 3. Water: . Water for domestic, commercial and industrial use will be provided at city rates, from existing water lines where available on the effective date of annexation and thereafter from new lines as may be extended in accordance with the utility extension policies of the City. 4. Sewer: Wastewater usage for domestic, commercial-and industrial use will be provided at city rates, from existing city lines where available on the effective date of annexation and thereafter from new lines as may be ex- tended in accordance with the utility extension policies of the City. 5. Inspection Services: Any inspection services now provided by the City (building, plumbing, electrical, etc. ), will be available in the annexation area on and after the date of annexation. 6. Planing an Zoning: Planning. and. Zoning jurisdiction of the City will extend to the annexed area on and after the effective date of annexation. 7. Street Lighting: Street lighting will be installed in substantially developed area(s) in accordance with established policies of the City and within the capability of the Guadalupe Valley Electric Co-op. 8. Street Name Signs: Street name signs, where required, will be installed. 9. Miscellaneous: All recreational facilities provided by the City will become available to all residents of the land being annexed on and after the effective date of annexation. Tommy M.
