ORD 110 06/06/1974 • a • 111, • C/C of Ordinance- - - City of Cibolo VOL 486 PALE 120 ORDINANCE NO. 110 ORDINANCE ACCEPTING PROVISIONS OF TITLE 28, TEXAS REVISED CIVIL STATUTES OF 1925, AS AMENDED, RELATING TO CITIES AND TOWNS THE STATE OF TEXAS 1 3215 COUNTY OF GUADALUPE X CITY OF'CIBOLO11 ON THIS, the 6th day of June, 1974, the City Council of the City of Cibolo, Texas, convened in regular session, at the regular meeting place thereof in the City Hall, the meeting being open to the public and notice of said meeting having been given as prescribed by Article 6252-17, Section 3A, V.A.T.C.S., there being present and in attendance the following members, to wit: F. S. SCHLATHER MAYOR EDWARD LING ) MRS. ALWIN LIECK ) FRED NIEMIETZ ) ALDERMEN MARGE SMITH ) and Linda N. Ling CITY SECRETARY and with the following absent: TED DYKES constituting a quorum; and among other proceedings had were the following: Mayor Schlather introduced a proposed ordinance, which was read in full . Alderman MARGE SMITH made a motion that any rule requiring ordinances to be read at more than one meeting be suspended. The motion was seconded by Alderman EDWARD LING and carried by the following vote: AYES: Aldermen Ling, Lieck, Niemietz, and Smith. NOES: None. Alderman FRED NIEMIETZ made a motion that said ordinance be finally passed and adopted. The motion was seconded by Alderman LIECK and carried by the following vote: AYES: Aldermen Ling, Lieck, Niemietz, and Smith. NOES: None. The Mayor announced that the ordinance had been finally passed and adopted. The ORDINANCE is as follows: • Aft 411 • 411 VOL 486 hula AN ORDINANCE by the City Council of the City of Cibolo, Texas , accepting for and on behalf of the City of Cibolo, Guadalupe County, Texas , the provisions of Title 28, Texas Revised Civil Statutes of 1925, and amend- ments thereto, relating to cities and towns. WHEREAS , Article 961, Revised Civil Statutes of Texas, 1925, as amended, provides -- "Any incorporated city, town or village in this State, containing six hundred inhabitants or over, however, legally incorporated, and any incorporated city, town or village of whatever population containing one or more manufacturing establishments, within the corporate limits, may accept the provisions of this title relating to cities and towns , in lieu of any existing charter, by a two-thirds vote of the council of such city, town or village, had at a regular meeting thereof, and entered upon the journal of their proceedings, and a copy of the same signed by the mayor and attested by the clerk or secretary under the cor- porate seal, filed and recorded in the office of the County Clerk in which such city, town or village is situated, and the provisions of this title shall be in force, and all acts theretofore passed incorporating said city, town or village which may be in force by virtue of any existing charter, shall be repealed from and after the filing of said copy of their proceedings as aforesaid. When such city, town or village is so incorporated as herein provided, the 'same shall. be known as a city or twon, subject to the provisions of this title relating to cities and towns, and vested with all the rights, powers , privileges and immunities and franchises therein conferred. The provisions of this title shall not apply to any city, town or village until such provisions have been accepted by the council in accordancewith this Article. Acts 1875 , po 113; G.L. WHEREAS , the City of Cibolo is duly incorporated under the provisions of Chapter 11, Title 28, Revised Civil Statutes of the State of Texas , as amended; and WHEREAS , it is found and declared that said City has one or more manufacturing establishments within its corporate limits ; and WHEREAS , the City Council of said City deems it advisable for said City to accept and adopt provisions of Title 28, Texas Revised Civil Statues of 1925, and amendments thereto, relating to cities and towns , and thereby become vested with all the rights, powers and privileges conferred upon cities and towns incorporated under the General Laws of this State; therefore, • • VO_ .486 ;PAGE 1:2 2 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS : SECTION 1: That the City of Cibolo, Texas , hereby adopts and accepts as its organic law all of the provisions of Title 28, Texas Revised Civil Statutes of 1925, and amendments thereto, relating to cities and towns . SECTION 2 : That said Town shall hereafter be subject to all provisions of Title 28, Texas Revised Civil Statutes of 1925, and amendments thereto, relating to cities and towns incorporated under the General Laws, and shall be vested with all the rights , - powers, privileges and immunities and franchises therein con- ferred. SECTION 3: That this oridnance shall be entered upon the official Minutes of the City Council of the City of Cibolo, Texas, and a copy thereof, signed by the Mayor and attested by the City Secretary, under the corporate seal of the City, shall be filed and recorded in the office of the County Clerk of Guadalupe County, Texas . SECTION 4: That the public importance of this measure and the fact that it is to the best interest of the inhabitants of this municipal corporation to adopt the provisions of said Title 28, Texas Revised Civil Statutes of 1925, and amendments thereto, at the earliest possible date constitute and create an urgent public necessity, requiring that any rule providing for ordi- nances to be read at more than one meeting be suspended; and requiring that this ordinance be passed and take effect as an emergency measure, and such rule and provisions is accordingly suspended and this ordinance is passed as an emeregency measure, and shall take effect and be in force from and after its passage and it is so ordained, PASSED AND APPROVED, this the 6th day of June 1974. I FURTHER CERTIFY that said ordinance was adopted at a regular meeting of the City Council, FIVE (5) members being present, and is of record in Book 1 of the Minutes of said City Council, I as duly signed by the Mayor and attested by the City Secretary under the corporate seal of said City.
