Min CC 12/15/2014 - Special y OF -C/0.. O U 10 "City of Choice" Special City Council CIBOLO MUNICIPAL BUILDING 200 S.MAIN December 15,2014 6:30 P.M. MINUTES 1. Call to Order—Mayor Jackson called the meeting to order at 6:30 p.m. All Members of council were present. Councilman Russell gave the invocation and all in attendance recited the Pledge of Allegiance. 2. Citizens to be Heard This is the opportunity for visitors and guests to address the City Council on any issue. City Council may not debate any non-agenda issue, nor may any action be taken on any non-agenda issue at this time, however, City Council may present any factual response to items brought up by citizens. The following citizens signed up to speak: Mark Buell- Gave a quote from Davie Crockett and welcome the Mayor to Texas and stated she had done a great job this past year in pulling the City together. Tim Bird was concerned with some of the actions that had taken place this past week. Mr. Bird read from the City Charter on the section covering ethics. Mr. Bird sated he would like to see the City move forward. Stan Boyle asked the Mayor and Council to step up and be leaders. He called for them to do the right thing and move forward as a City. Paul Miller stated that all boards, committees and commission as well as council just recently signed a new Ethics Ordinance. He felt this had been violated and it made Cibolo look bad. Mr. Miller asked that Councilman Castro resign not only as Mayor Pro-Tem but also as a Councilman. Brent Hartman stated this is nothing new and it breaks his heart to this happen again. Mr. Hartman talked about social media and Penal Code 39,Title 38 the miss-use of public information. Mr. Hartman would like council to consider opening an investigation on Mr. Castro. Bob Hicks also spoke that this type of behavior was not new and that a year ago there was enough evidence to warrant an investigation. Mr. Hicks stated that we now have an upright and honest Mayor that carries out the duties of Mayor for the City of Cibolo in an excellent manner. Glenn Weber thanked staff for a great parade. Mr. Weber also stated that one month ago when the Mayor Pro-tem was appointed by council many citizens heard concerns about the appointment. He felt that private messages should not be released to the public or news media. Mr. Weber praised the mayor for making no comment to the media and for a great job over the last year. Joel Hicks thanked everyone for a great parade. Stated he was displeased with actions that took place last week but understood he may not have all the facts but did see what was posted on face-book. Mr. Hicks asked the council to wait until January to appoint a new Mayor Pro-Tem to give them more time to think over their selection. Marj Buell showed a large list and stated that this is a list that council needs to be working on for the city and it does not include airing the cities dirty laundry to the media or on social media. She asked council to stop it. Carol Alvarado talked about the barbecue cook off scheduled for February and that she had tickets for the raffle if anyone wanted to purchase one. 3. Discussion/Action A. Discussion/Action on an ethics complaint that has been lodged against the Mayor. Councilman Doty requested to take this item into executive session. Motion was seconded by Councilman Hogue.Mayor Jackson stated the council will convene into executive session under Government Code Section 551.074 Personnel Matters at 6:58 p.m. Council reconvened into regular session at 7:06 p.m. Mayor Jackson read an e-mail she had sent to Councilman Castro on Sunday that read"I wish to extend my apologies for the text message I sent to you indicating to you to 1 "go to hell".I had a lapse in judgment after I ask you to lose my personal cell phone number." Councilman Castro accepted the apology and apologized to Mayor Jackson for his own actions,which included releasing the text messages to the media. Councilman Castro went on to say that Mayor Jackson is phenomenal for our city, we have good debate and discussion up here and never once attacked her in that regard. Council Hogue stated that council based on the admission of the mayor and according to the Ethics Ordinance they caution the Mayor to never do anything like this again in the future. There will be no formal reprimand. One citizen signed up to speak on this item: Mr.Ivie stated that he thought that this conflict being taken to social media was unprofessional especially that the city is starting a mentoring program with youth. B. Discussion/Action on the possible removal of the Mayor Pro-Tem. Councilman Hogue requested that this item be discussed in executive session. Motion was seconded by Councilman Doty. Mayor Jackson stated the council will convene into executive session under Government Code Section 551.074 Personnel Matters at 7:12 p.m. Council reconvened into regular session at 7:27 p.m. Councilman Castro official submitted his resignation as Mayor Pro-Tem. Councilman Hogue made the motion to accept the resignation from Councilman Castro. Motion was seconded by Councilwoman Schultes. For: Council Members: Dunn,Hogue,Russell,Doty, Castro, Garrett and Schultes;Against: None. Motion carried 7 to 0. C. Discussion/Action on the.possible appointment of a new Mayor Pro-Tem. Councilman Doty requested that this item be discussed in executive session. Motion was seconded by Councilman Dunn. Mayor Jackson stated the council will convene into executive session under Government Code Section 551.074 Personnel Matters at 7:29 p.m. Council reconvened into.regular session at 7:35 p.m. Councilman Hogue made the motion to table this item until the;--first meeting in January. Motion was seconded by Councilman Garrett. For: Council Members: Schultes,Garrett;Castro,Doty,Russell,Hogue and Dunn;Against: None. Motion carried 7 to 0. Jennifer Hartman had signed up to be heard on this item and stated that she thanked council for giving everyone the opportunity tonight to speak. Ms.Hartman also thanked the council for accepting the resignation of Councilman Castro as Mayor Pro-Tem and asked Mr.Castro to think hard and what he could do to better this city. Mr.Bird had signed up to be heard on item 3B but spoke at this time. He stated he did not know why Councilman Castro resigned as Mayor Pro-Tem didn't know if he violated an ethics policy or just couldn't get along with the mayor. If it was an ethics violation what is the difference if he is Mayor Pro-Tem or just a Council Member. Where is the line drawn to what is acceptable or not acceptable if we have no consequences for our actions. Councilman Dunn explained that if an ethics violation occurred this would be addressed at a later date as it is not on the agenda for discussion at tonight's meeting. Council has every intention to enforce the Ethics Ordinance they just put into effective last month. Before adjourning the meeting Mayor Jackson did addressed the audience and spoke about face-book and other social media mechanisms. They mayor stated she would not let social media ruin this City the City she loves. 4. Adjournment: Councilman Dunn made the motion to adjourn the meeting at 7:43 p.m. 'Motion was seconded by Councilman Garrett. For:All;Against:None. Motion carried 7 to 0.
