ORDINANCE I as
AN ORDINANCE OF THE CITY COUNCIL OF CIBOLO, TEXAS, REQUIRING
APPOINTEES TO BOARDS, COMMISSIONS AND COMMITTEES TO TAKE
AN OATH OF OFFICE, PROVIDING FOR NON -SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the statutes of this state and the City's Charter and Code of Municipal
Ordinances City Council has established boards, commissions and committees to serve the interest
of the City and its citizens; and
WHEREAS, pursuant to Article VIII of the City Charter, City Council appoints qualified citizen
volunteers to serve on such boards, commissions and committees and tasks such citizens to
represent the City and dutifully carry out the prescribed obligations of such appointments; and
WHEREAS, in furtherance of the objective that the City's business be conducted to the highest
profession and ethical standards City Council deems it appropriate that before appointment board,
commission and committee members take an oath of office:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CIBOLO, TEXAS:
SECTION I.
Amendment to Chapter 2, Article IV of the Code of Ordinances
THAT City Code of Ordinances Chapter 2 (entitled "Administration"), Article IV (entitled
"Boards and Commission's is hereby amended by the establishment of a new Division 6 which
shall read as follows:
DIVISION 6. OATH OF OFFICE
Sec. 2-261. — Oath required.
(a) Before acceptance for appointment on any board, commission or committee an appointee
shall take the following oath of office:
I, state your name, do solemnly swear (or affirm) that I will faithfully
execute the duties of my office to the, state the name of the board,
commission or committee, ofthe City of Cibolo, Texas, and will to the best
of my ability abide by the letter and spirit of the City of Cibolo's code of
ethics and conduct and shall preserve, protect, and defend the Constitution
and laws of the United States, the state of Texas, and the city of Cibolo, so
help me God.
(b) The oath of office shall be administered by the City Secretary or a designee of the City
Secretary who holds the office of Notary Public by the state of Texas.
(c) The oath of office shall be memorialized on such form as is provided by the City Secretary
and the appointee's signature shall be affixed thereto and witnessed by the City Secretary
or a designee of the City Secretary who holds the office of Notary Public by the state of
Texas. The oath of office shall be preserved in the public records of the City Secretary.
(d) The purpose for requiring appointees to take an oath of office, as a condition of acceptance
of appointment, is to emphasis the importance of conducting one's self in the highest
ethical and professional manner as an appointee. Appointees to boards, commissions and
committees, who have taken an oath of office under this section, shall continue to serve at
the pleasure of City Council.
SECTION II.
Amendment to Chapter 2, Article VIII of the Code of Ordinances
THAT City Code of Ordinances Chapter 2 (entitled "Administration"), Article VIII (entitled
"Code of Ethics") Section 2-503 (entitled "Standard of Ethical Conduct") subsection (b) (entitled
"Additional standards of ethical conduct")is hereby amended by the addition of a new subsection
(b) (7) which shall read as follows:
(7) Oath of Appointment. An appointee to a board, commission or committee shall abide by the
terms of their oath of appointment.
SECTION III
THAT all provisions of the Code of Ordinances of the City of Cibolo not herein amended
or repealed shall remain in full force and effect.
SECTION IV
THAT all other ordinances or parts of ordinances in conflict herewith are hereby repealed to
the extent that they are in conflict.
SECTION V
THAT this ordinance is not severable.
SECTION VI
THIS ordinance will take effect upon its passage, approval and publication as provided by law.
