ORD 1216 09/26/2017Of C/$ „wm 0 _ r,_0 o Texns 'Pity of Choice" ORDINANCE —1216 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS AMENDING THE UTILITY FEE SCHEDULE OF THE CITY OF CIBOLO; AMENDING SECTION 78-141; AMENDING SECTION 78-143(a); PROVIDING FOR ADOPTION THERETO; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE OF ALL OTHER ORDINANCES OF THE CITY NOT IN CONFLICT WITH THE PROVISIONS OF THIS ORDINANCE; PROVIDING FOR PUBLICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR SAVINGS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 78-64 of the City of Cibolo's Code of Ordinances establishes that rates, fees, deposits and charges for services furnished by city's utility department shall be established by ordinance or resolution of the city council, from time to time, and made available for public examination in the office of the city secretary; WHEREAS, City of Cibolo has experienced an increase in direct water supply costs by Canyon Regional Water Authority; WHEREAS, Section 78-141 and Section 78-143(a) specify a maximum consumption for the minimum monthly base charge; WHEREAS, in a budget workshop of City Council, conducted on August 16, 2017, after publication provided by law, the Finance Director demonstrated the need to revise Section 78-141 and Section 78-143(a) as to the maximum consumption for the minimum monthly base charge; WHEREAS, after due consideration of the information presented City Council deems it appropriate to amend and/or clarify the utility fee schedule and Section 78-141 and 78-143(a): NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO TEXAS: SECTION 1 That the above and foregoing premises are true and correct and are incorporated herein and made part hereof for all purposes. Utility Fee Schedule Ordinance Page 1 of 6 SECTION 2 ADOPTION That the City Council of the City of Cibolo, Texas hereby establishes utility rates and fees, as provided for in the Attached Exhibit "A". SECTION 3 CODE AMENDMENT That Section 78-141, of the Cibolo Code, (entitled "Metering Requirements"), be amended to read as follows: All water distributed to individual customers will be metered. Normally, not more than one household shall purchase water through any single meter without the consent of the city council. Single metering is authorized for more than one unit of occupancy providing responsibility for payment of all utility services for the single meter billing is assumed by the single property owner. In cases where single metering is to be used for more than single-family residence, a meter sufficient in size to meet total requirements will be required. Size of meter will be determined by the maintenance officer at time of request and deposit required will be based on meter size. Provided, where a residence, business establishment, complete apartment or manufactured house is not accessible to a city water main, arrangements may be made, at the option of the city and for which a permit must be obtained from the city council, to secure water from another user of city water, in which case the minimum monthly charge shall be made for each additional residence taking water through such meter. Each minimum will entitle user to 1,200 gallons per month. The minimum charge plus any additional minimum charge and all water used over the minimums by such consumer shall be charged to the customer having the meter. The city shall keep all meters in good repair without any expense to the consumer except as provided herein. That Section 78-143, of the Cibolo Code, (entitled "Fees Rates and billing procedures"), subsection (a), be amended to read as follows: (a) Each customer upon making application shall pay a nonrefundable account setup fee and shall provide a refundable deposit as specified in the utility fee schedule. If a prospective customer is indebted to the city for water, sewer, or garbage service, service at the new residence or place of business will not be provided until the outstanding indebtedness is satisfied. Residential and commercial water bills will be forwarded no later than the first workday of each month. Bills on residential accounts will consist of a minimum base charge for up to 1,200 gallons consumption, and a per 1,000 -gallon charge for consumption above the base charge. Residential customers who use less than 1,200 gallons in any one month will qualify for a discounted special rate for that month. Bills on commercial accounts will consist of a minimum base charge, based on meter size, for up to 1,000 gallons of consumption and a per 1,000 gallon charge for consumption above the base charge. Utility Fee Schedule Ordinance Page 2 of 6 That Section 78-143, of the Cibolo Code, (entitled "Fees Rates and billing procedures"), subsection (b), not be amended. SECTION 4 CUMULATIVE CLAUSE That this Ordinance shall be cumulative of all other ordinances of the City of Cibolo, Texas, except where the provisions of this Ordinance are in direct conflict with the provisions of such other ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 5 PUBLICATION This Ordinance shall be published in a newspaper of general circulation in the City of Cibolo prior to its consideration and adoption by the Cibolo City Council, in compliance with the provisions of the City Charter and State Law. SECTION 6 SEVERABILITY That it is hereby declared to be the intention of the City Council of the City of Cibolo that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance should be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of the Ordinances, since the same would have been enacted by the City Council without incorporation in this ordinance of any such unconstitutional phrases, clause, sentence, paragraph or section. SECTION 7 SAVINGS That all rights and privilege of the City of Cibolo are expressly saved as to any and all violations of the provision of any Ordinances affecting the utility rates, which have accrued at the time of the effective date of this Ordinance; and, as to such accrued violation and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. The City's utility fee schedule is being amended to fund the increased costs of water supply and future water source development. The City's fiscal year 2018 proposed budget is based on these revised rates. The proposed changes are shown below (and shown in blue font in the ordinance).
