ORD 38 08/18/1971 • O. * 111 • er No. 38 AN ORDINANCE REGULATING THE DISPOSITION OF GARBAGE, RUBBISH, WEEDS, TRASH OR OTHER WASTE MATERIAL WITHIN THE CITY LIMITS OF THE CITY OF CIBOLO, TEXAS, PROVIDING FOR A PENALTY AND CONTAINING A SEVERANCE CLAUSE. BE IT ORDAINED BY THE CITY COUNCEL OF THE CITY OF CIBOLO, TEXAS: Section 1 - It shall be unlawful for any person to place, deposit, or throw, or permit or cause to be placed, deposited or thrown, any garbage, brick, broken or liquid concrete, ashes, clinkers, cinders, dirt, plaster, sand or gravel, automobile frames, dead trees, and all other bulky and heavy material, brush, broken glass, bottles, loose waste or refuse of any kind, on public or private property outside of any house, building, or tenement in the city, unless the same has been deposited in accordance with the provisions of this ordinance. The presence of garbage, brush, rubbish or miscellaneous waste upon any street, alley or public place shall be held to constitute a violation of this section on the part of the owner or occupant upon whose half of the alley or street such garbage, brush, rubbish or miscellaneous waste is permitted to remain for longer than seventy-two (72) hours. The following acts, among others, are declared to be unlawful and in violation of this section, but such enumeration shall not be deemed to be exclusive, viz: (1) The throwing, placing, dumping, or depositing of any lawn trimmings, hedge trimmings, or any other cuttings or trimmage of weeds, flowers or other vegetation on lots, vacant or occupied, driveways or other private property. (2) The throwing, placing, dumping or depositing of any lawn trimmings, hedge trimmings or other cutting or trimmings of weeds, 411 All 411 411 41 410 lor • flowers, or other vegetation on or in any gutter, street, sidewalk, parkway, driveway, curb, alley or on any other public property in the city. (3) The throwing, placing, dumping or depositing of any gar- bage, refuse or animal or vegetable waste matter of any kind on or in any gutter, street, sidewalk, parkway, driveway, curb, alley or any other public property of the city, or in or on any lot, vacant, or occupied, driveway or other private property in the city. (4) The throwing, placing, dumping, or depositing of any heavy accumulation such as brick, broken concrete, liquid concrete or waste concrete discharged from a concrete dump truck, ashes, clinkers, cinders, dirt, plaster, sand or gravel, automobile frames or dead trees, on or in any gutter, street, sidewalk, parkway, driveway, curb, alley, or on any other public property of the city, or in or on any lot, vacant or occupied, or other private property in the city. Section 2 - Any such waste material heretofore defined above shall not be discharged, dumped, or unloaded at any place within the city or its jurisdiction, except in adequate containers for removal by garbage trucks or other vehicles within five (5) days after the date of deposit or at a designated city dump ground or at such other place as may be designated by the manager of utilities. Section 3 - Any person violating the provisions of this Ordi- nance shall be guilty of a misdemeanor and shall be subject to a fine of not less than Five and No/l00 ($5.00) DOLLARS and not more than Two Hundred and No/l00 ($200.00) DOLLARS, and each day that such con- dition, as herein defined, shall exist in violation of this Ordinance shall constitute a separate offense. Section 4 - All of the provisions of this Ordinance are sever- able so that any portion :hereof, which might be deemed to be void as a matter of law, shall not affect the validity of any other portion hereof.
