ORD 764 09/12/2006 ORDINANCE NO. 764 AN ORDINANCE ESTABLISHING ZONING CLASSIFICATION FOR A 11.793 ACRE TRACT OF LAND OWNED BY LARRY L. AIKEN TO BE RE-ZONED FROM COMMERCIAL LIGHT DISTRICT (C-1) TO RESIDENTIAL SINGLE- FAMILY MEDIUM DENSITY DISTRICT (R-2B) AND AMENDING THE CITY OF CIBOLO ORDINANCE NO.609 BY ESTABLISHING SUCH ZONING. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO: Section 1. Whereas two Public Hearings were held to discuss such rezoning, the first being on August 15, 2006 at 7:00 P.M. in the Cibolo City Hall; and the second being on Tuesday, September 12, 2006, at 7:00 P.M. in the Cibolo City Hall, for the purpose of providing all interested persons the opportunity to be heard concerning the proposed rezoning from C-1 to R-2B zoning of 11.793 acres of land by the City of Cibolo. The property was annexed into the City on May 7,2002 and zoned to C-1. The Thoroughfare component of the Master Plan designates Green Valley as a Secondary Arterial with 86 feet of right-of-way. Green Valley will be realigned off-site in conformance to the Master Plan with adjacent development. No other major thoroughfares are planned through or adjacent to this site. ZONING: This property was recently acquired by the petitioner for inclusion into the Charleston Parke Subdivision. Unit I has been Final Platted. Unit II Final Plat was approved at the City Councils June 27, 2006 meeting. Unit I and Unit II of Charleston Parke were platted under previous Zoning Ordinance No.367. With Commercial-Light (C-1) zoning, the property is allowed to develop single-family lots at 7,500 square feet, with no lot depth or width minimums, 25 foot front yards, 15 foot rear yard and 10 foot side yards. C-1 allows lot coverage of up to 75 percent. Additionally, C-1 zoning allows a plethora of other uses, including 24 DU/acre high density residential, commercial and non-residential activities as well as any lesser zoning district use. R2-B allows a 6,000 square foot lot minimum at 55 foot wide by 100 foot in depth with 25 foot front, 15 rear and 5 foot side yards. R2-B allows lot coverage up to 40 percent. The requested zone change to R2-B district falls within the Land Use Map density restrictions with a minimum lot of 6,000 square feet. No more than 53 lots would be allowed with this land use designation. The applicant is proposing approximately 44 single family lots in this project with a future plat,well within the margin of the maximum allowable Master Plan DUA at approximately 3.68 DUA. OTHER ISSUES: Although this is not an issue relative to the zone change,the applicant has continued to work with Kove Lane residents regarding access issues. Any issues will be resolved with the final plat. CONCLUSIONS: The proposed zone change complies with the City of Cibolo Master Plan as discussed and is compatible with surrounding uses. Redevelopment of the land as a commercial (C-1) parcel mid- block of this site is unlikely to occur considering the commercial intersections nearby and the lack of access to the site necessary for a commercial endeavor. This request is an extension of a current development project and will cause less impact than those uses allowed under the current commercial zoning district. Eighteen notices were sent to surrounding property owners. Four notices were received back, three in favor and one neutral to the petition. A number of residents attended the P&Z public hearing in favor of the petition. One resident disfavored the petition primarily due to Kove Lane. It was explained to the residents that the land is currently zoned commercial and that it could potentially develop as multi-family up to 24-dwellings per acre, office, retail, commercial, amusements, or institutional activities,75-percent lot coverage.
