AN ORDINANCE AMENDING THE CITY OF CIBOLO'S CODE OF ORDINANCES
CHAPTER 2, ARTICLE IV BOARDS AND COMMISSIONS PROVIDING FOR THE

PROVIDING THAT THIS ORDINANCE IS CUMULATIVE OF ALL OTHER
ORDINANCES OF THE CITY OF CIBOLO NOT IN CONFLICT WITH THE
PROVISIONS OF THIS ORDINANCE; PROVIDING FOR SEVERABILITY;
PROVIDING SAVINGS;AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Cibolo is a home rule municipality given broad discretionary powers under the
Texas Constitution to regulate for the public health, safety and general welfare of its citizens; and
WHEREAS,the City Council of the City of Cibolo finds that recreational activities, events, and festivals
are a vital and integral part of a municipality's health and general welfare; and
WHEREAS,the City Council of the City of Cibolo finds that providing its citizens recreational activities,
community events, and festivals serve a legitimate public goal; and
WHEREAS,the City Council hereby fmds and determines that certain other procedural and administrative
clarifications are necessary to be provided in the existing regulations; and
WHEREAS,the City Council of the City of Cibolo hereby fmds and determines that certain amendments
should be made to the organization and structure of the Committee; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO,
TEXAS:
I.
Chapter 2,Article IV of the City Code of Ordinances for the City of Cibolo, Texas,hereby is
amended by replacing the existing language with the language that follows:
SECTION 2-190—Creation; Composition; Qualification;Appointment; Attendance; Terms.
(a) A committee of the City Council of the City of Cibolo, Texas is hereby created which shall be
known as the CiboloPa rk5 �(p�►inuu f Advisory Committee. The Committee shall consist of
seven(7)members and two (2) alternates.
(b) A chairperson, vice-chairperson shall be elected in January of each year from among the
Committee members. In the absence of both the chairperson and vice-chairperson,the
Committee shall appoint an acting chairperson. The individual elected as the Chairperson and
Vice Chairperson must have completed Open Meetings Act,Public Information Act, and Ethics
training.
(c) Qualifications, appointments, attendance, terms, and other applicable aspects of Committee
structure and operation shall be in accordance with City Council Policy Directive No. 2016-003.
SECTION 2-197—General Responsibilities and Duties.
The ,xk5 Commwu1)Advisory Committee shall have the following responsibilities and duties:
(1) Act in an advisory capacity in matters pertaining to recreational activities, community events,
and festivals.
(2) Assist City staff in the planning of Committee programs which enhance the social and
recreational needs of the community,promote and stimulate public interest therein and, solicit
the cooperation of the school district and other public and private agencies, as may be needed.
(3) Actively volunteer and donate appropriate time to assist City staff in coordinating and working
community events and festivals in a reliable and consistent manner.
(4) Advise on special requests from outside interest groups for special use of any of the public park
amenities owned by the City.
(5) Assist in the development of Committee programs and non-profit supporting organizations
which benefit the Cibolo community.
(6) Highlight and promote City of Cibolo park activities and City-sponsored events.
(7) New members of the favk %Of`►1WWII Advisory Committee shall upon appointment:
(a) Receive a copy of the Committee ordinance.
(b) Complete Open Meetings Act training within the first thirty(30) days.
(c) Complete Public Information Act training within the first thirty(30) days.
(d) Attend ethics training in February of each year to remain an active member.
(e) Be registered to vote in Cibolo, Texas.
SECTION 2-198—Expenditures and Obligations.
Whenever it is deemed necessary by the Committee to incur any expenses in performing the duties
assigned to it, an estimate of such proposed expenses shall be submitted to the City Council and City
Manager. No debts of any kind or character shall be made or incurred by the Committee or anyone
acting for it,unless such expenditures have been specifically authorized by the City Council prior to the
time such obligations are incurred.
II.
Severability
If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be
invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and;
III.
Repeal
All ordinances or parts of ordinances in conflict with any of the provisions of this ordinance are hereby
repealed insofar as the same is in conflict with the provisions hereof; and
Effective Date
This ordinance shall become effective immediately upon its passage and publication as required by law.
