AN ORDINANCE ANNEXING THE HEREIN AFTER DESCRIBED
TERRITORY INTO THE CITY OF CIBOLO,TEXAS AND EXTENDING THE
BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE SUCH PROPERTY
WITHIN THE CITY LIMITS.
WHEREAS,a petition for annexation has been heretofore filed by Mr.James Hardy,Jr.,being the owner
of certain land in the extra-territorial jurisdiction of the City of Cibolo,Guadalupe County,Texas said
land being described in paragraph 1 below,and
WHEREAS, Cibolo City Council approved the annexation on March 9,2004, and
WHEREAS, said petition in form and substance,fully complies with all of the provisions of Section
43.028,Local Government Code,V.A.T.S. and
WHEREAS,said tract of land is contiguous and adjacent to the City of Cibolo,is not more than one-half
mile in width and is vacant and without residents;and
WHEREAS,the City Council is of the opinion that said petition should be granted and that such tract of
land should be annexed to the City;NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO,TEXAS
The property herein abstracted consists of all that certain tract or parcel of land,being 48.835 Acres of
Land more or less, situated in the SEXTO Dominguez Survey No. 152,Abstract No. 110,Guadalupe
County,Texas,being the same tract called 48.85 acres of land recorded in Volume 1774,Page 652,
Official Public Records, Guadalupe County, Texas and described more particularly by metes and bounds
as follows:
POINT OF BEGINNING: Beginning at a point for the northwest corner of this tract herein
described, said point being the southwest corner of a 3.229 acre tract as
recorded in Volume 521,Page 53,Deed Records,Guadalupe County,
Texas,in the northeast right-of-way line of F.M. 1103;
THENCE N 61. 12' 18"E,938.61 feet to a point for an interior corner of this tract
herein described, said point being in the west line of said called 15.385
acre tract and the east corner of said 3.229 acre tract;
THENCE S 30°19' 18"E,343.86 feet to a point for an interior corner of this tract
herein described, said point being the southwest corner of a 15.385 acre
tract as recorded in Volume 570,Page 527,Deed Records, Guadalupe
County,Texas;
THENCE N 60. 07'00"E, 1376.84 feet to a point for a corner,said point being
southeast corner of said 15.385 acre tract and being on the west right-of-
way line of Weil Road;
THENCE S 29°37' 10"E,366.99 feet with the west right-of-way line of Weil Road
to a point for the east corner of this tract herein described, and being the
northeast corner of a called 4.81 acre tract recorded in Volume 1774,
Page 565,Deed Records of said county;
THENCE Leaving west right-of-way line of Weil Road with the common line of
said 4.81 acre tract and this tract herein described the following two
courses:
S 60. 05'35"W, 640.23 feet to a point for a corner of this tract,
S 14. 55'44"E,313.16 feet to a point for a corner of this tract,and being
a common corner of a called 2.87 acre tract recorded in Volume 1774,
Page 565,Deed Records of said county, and a called 7.26 acre tract
recorded in Volume 545,Page 632,Deed Records of said county;
THENCE S 30. 03'35"E, 662.90 feet with the common line of said 7.26 acre tract
and 48.85 acre tract to a point for the southeast corner of this tract and a
common corner of said 7.26 acre tract and a called 4.19 acre tract
recorded in Volume 1432,Page 406,Deed Records of said county,and a
called 5.80 acre tract recorded in Volume 544,Page 44,Deed Records of
said county;
THENCE S 59. 55'21"W, 645.13 feet with the common line of this tract herein
described and said 5.80 acre tract and a called 2.230 acre tract recorded
in Volume 625,Page 432,Deed Records of said county,to a point for the
southern most corner of this tract and being a common corner of said
2.230 acre tract and a called 5.15 acre tract recorded in Volume 1183,
Page 898,Deed Records of said county,a called 6.068 acre tract
recorded in Volume 1455,Page 551,Deed Records of said county;
THENCE N 30.20'41"W, 553.79 feet along the common line of said 6.068 acre
tract and a called 6.068 acre tract recorded in Volume 1820,Page 181,
Deed Records of said county,to a point for an interior corner of this
tract;
THENCE S 59. 54'32" W,951.42 feet,along common line of this tract and the
above mentioned 6.068 acre tract to a point for a corner in the northeast
right-of-way line of F.M. 1103;
THENCE N 29.37'25" W, 573.73 feet to a point for a corner of this tract and
being the southwest corner of a called 2.030 acre tract recorded in
Volume 663,Page 120,Deed Records of said county;
THENCE With the common line of said 2.030 acre tract and this tract herein
described the following three calls:
N 60. 03'47"E,419.81 feet to a point for a corner,
N 290 53'57" W,210.13 feet to a point for a corner,
S 60. 06'36"W,419.43 feet to a point for a corner of this tract herein
described, said point being the northwest corner of said 2.030 acre tract
in the northeast right-of-way line of F.M. 1103;
THENCE N 29.44'26" W,362.06 feet along the northeast right-of-way line of F.
M. 1103 to the Point of Beginning and containing 48.835 acres of land
more or less.
2. The City Secretary is hereby directed to file a certified copy of this ordinance together with a copy of
said petition with the County Clerk of Guadalupe County,Texas.
3. This ordinance shall take effect immediately upon passage and approval.

Dear Ms . Griffin:
This refers to the annexations (Ordinance Nos . 629 through
634 (2004) ) to the City of Cibolo in Guadalupe County, Texas,
submitted to the Attorney General pursuant to Section 5 of the
Voting Rights Act, 42 U. S . C. 1973c. We received your submission
on April 13 , 2004 .
The Attorney General does not interpose any objection to the
specified changes . However, we note that Section 5 expressly
provides that the failure of the Attorney General to object does
not bar subsequent litigation to enjoin the enforcement of the
changes . See Procedures for the Administration of Section 5 of
the Voting Rights Act (28 C.F.R. 51 .41) .
