ORD 1018 08/14/2012 o F' c tdaapgl �o4,�� , ?411 1g \ V r O 4, 1 x 1 \ �d``r ,a ''ry�aiimrxr����d T£.x 5 "City of Choice ORDINANCE 1018 AN ORDINANCE OF THE CITY OF CIBOLO, TEXAS,REPEALING ARTICLE IV OF CHAPTER 74 (TRAFFIC AND VEHICLES), SECTION 74-98 OF THE CODE OF ORDINANCES AND AMENDING SECTION 74-98 BY MODIFYING SCHOOL ZONE TIMES FOR BYRON STEELE HIGH SCHOOL; PROVIDING A SAVINGS, CUMULATIVE,AND SEVERABILITY CLAUSE AND EFFECTIVE DATE. WHEREAS the City Council of the City of Cibolo,Texas desires to protect the safety and welfare of its citizens; and WHEREAS the City Council realizes that a control of speed limits around and near school campuses is necessary to protect the safety of school children on their way to and from school; and WHEREAS, the City's School District has advised that Byron Steel High School's lunch period for its students has been extended from 11:30 a.m. — 1:30 p.m. to 10:30 a.m.— 2:10 p.m. Based on this change, the City staff has determined that the existing established school zone time frame of 11:30 a.m. — 1:30 p.m.is no longer sufficient to protect the students of the school who will be crossing F.M. 1103 during and returning from lunch under the school's new lunch times and recommends that the City's Code be amended to conform to these new lunch times. NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO,TEXAS,THAT: Section 1. Repealer. Article IV of Chapter 74, Section 74-98 (d) of the City of Cibolo's Code of Ordinances is hereby repealed. Section 2. Chapter 74,Article IV, Section 74-98 is now amended to read as follows: 74-98 School Zones Established 200 South Main Street,P.O.Box 826,Cibolo,Texas 78108 Phone: 210-658-9900 Fax: 210-658-1687 (d) High Schools. The following streets, or portions thereof, are designated as school zone and it is unlawful for a person to drive or operate a vehicle at a speed in excess of 35 miles per hour in any of those zones when signs are in place giving notice of the speed limit, on Monday through Friday,when school is in session, during the hours of 7:30 a.m. to 9:00 a.m., from 10:30 a.m. to 2:15 p.m. and 3:30 p.m. to 4:30 p.m. at the following locations: Byron P. Steele II High School (1) F.M. 1103, from MP 4.744 easterly to MP 5.098 for an approximate distance of 0.354 miles. As determined by Texas Department of Transportation minute order 110835. Section 3. Relationship to other remainder of Code. All provisions of Chapter 74,Article IV, Section 74-98 of the City of Cibolo's Code of Ordinances not herein amended or repealed shall remain in full force and effect. Section 4. Savings Clause.The repeal or amendment of any ordinance or part of the City's Code of Ordinances effectuated by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering a penalty accruing or to accrue or as affecting any rights of the City of Cibolo under any section or provisions of any ordinances or the City's Code of Ordinances in effect at the time of passage of this ordinance. Section 5. Cumulative Clause. The provisions of this ordinance shall be cumulative of all ordinances not repealed by this ordinance and ordinances governing or regulating the same subject matter as that covered herein. This ordinance shall not be construed to require or allow any act which is prohibited by any other ordinance. Section 6. Severability. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance shall be declared invalid by judgment or decree of any court of competent jurisdiction, such invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance or Section of the Code which this ordinance is contained and the remainder of this Section of the Code and ordinance shall be enforced as written. Section 7. The Chief of Police and City Engineer are hereby authorized and directed to erect the appropriate signs indicating the herein enacted school zones. Section 8. That any person found guilty of violating this ordinance will be fined not more than $200.00 for each offense.
