AN ORDINANCE ESTABLISHING ZONING CLASSIFICATION FOR A
2.000 ACRE TRACT OF LAND OWNED BY DONALD AND LAUREL
CALE TO BE RE-ZONED FROM COMMERCIAL LIGHT (C-1) TO
COMMERCIAL BUSINESS DISTRICT — MEDIUM DENSITY RETAIL
(C-2R); PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CIBOLO,TEXAS:
SECTION I.
Whereas two public hearings were held to discuss such rezoning, the first being on
Tuesday, January 19, 2010 at 7:00 p.m. in the Cibolo City Hall; and, the second being on
Tuesday, January 26, 2010 at 7:00 p.m. in the Cibolo City Hall, for the purpose of providing all
interested persons the opportunity to be heard concerning the proposed rezoning 2.000 acres
from C-1 to C-2R by the City of Cibolo.
SECTION II.
And whereas the description of the 2.000 acres of land which is to be rezoned to C-1R is
described in Exhibit "A" (metes and bounds) and Exhibit "B" (survey exhibit), attached hereto
and made part of this ordinance.
SECTION III.
This Ordinance shall take effect immediately upon its passage.
PASSED, APPROVED, AND ADOPTED THIS 9111 DAY OF FEBRUARY, 2010.

THAT WAYNE F. MEEKER and wife, 'VIRGINIA P. MEEKER, hereinafter called '
Grantor, for and in consideration of the sum of TEN AND NO(100 .DOLLARS
-($10.00) cash -and other good and valuable consideration in hand paid by '
DONALD CALE and wife, ELIZABETH ANNE CALE,. hereinafter called Grantee, the
receipt and sufficiency of which is hereby acknowledged and confessed and
the further consideration of the assumption and agreement to pay by the
Grantee herein according to the terms, conditions and stipulations, of the
Note and Deed .of Trust given as security therefor, the balance of SEVEN
THOUSAND NINE HUNDRED THIRTY-SEVEN AND 58/100 DOLLARS ($7 ,937.58) owed on
that certain Promissory Note in the original principal• sum of NINE THOUSAND
SIX HUNDRED AND NO/100 DOLLARS ($9, 600.00) , dated September 27 , 1976,
executed by WAYNE F. MEEKER and wife,, VIRGINIA P. MEEKER, payable to the
order of MARY A. CUNNINGHAM, a feme sole, at CIBOLO STATE BANK Account No.
801-399, in monthly installments, including interest, .as therein provided,
said Deed of Trust being of even date therewith, given to MICHAEL B. FETTER,
Trustee, recorded in Volume 139 on Page 426, et seq. , of the Deed of Trust
Records of Guadalupe County, Texas;
-HAS GRANTED, SOLD and CONVEYED, and by these presents does GRANT, SELL and
' CONVEY unto the said Grantee, the following described property, to-wit:
BEING 2.00 acres of land situated in the Third Tract in a con-
veyance to Fred L. Cunningham, et ux, Volume 286., Page 142,
Geronimo Leal Survey No. 85, A-210, Guadalupe County, Texas, and
described by metes and bounds as follows;
BEGINNING at an iron pin found at the South corner of the Third
Tract, Volume 286, Page 142, and situated in the Northwest R.O.W.
of a County Road;
THENCE N. 31° 22' W. 427.7' to an iron piri found in the South
• R.O.W. of F.M. Road 7.8;
- -THENCE-with-the -South R.O:W-. of F.M. Road_ 7B N. 84° 43' E. 259.7'
• • to an iron pin set for the North corner of this 2.00 acre tract;
THENCE S. 31° 22' E. 319.3' to an iron pin set in the Northwest
R.O.W. of a County Road;
• THENCE with the Northwest R.O.W. S. 60° 03' W. 233.3' to the PLACE
OF BEGINNING, and containing 2..00 acres of land, according to a
survey made on the ground under the supervision of Raymond Dietert,
R.P.S. 1868, made in September, 1976.

This conveyance is made subject to, all and singular, the restrictions,
conditions, easements and covenants, if any, applicable to and enforceable -
against the above described property as reflected by the records of the
County Clerk of Guadalupe County, Texas.
Taxes for the current year have been prorated and,.•are assumed by
Grantee.
TO HAVE AND TO HOLD the above described premises, together with, all
and singular, the rights and appurtenances thereto in anywise belonging
unto the said Grantee, Grantee's heirs and assigns forever.
Grantor does hereby bind Grantor, Grantor's heirs, executors and
administrators to warrant and forever defend, all and singular, the said
premises unto the said Grantee, Grantee's .heirs and assigns, against every
person whomsoever claiming or to claim the same or any part thereof.
