ORD 865 08/12/2008 ORDINANCE NO. 865 AN ORDINANCE ESTABLISHING SCHOOL ZONES AND SPEED LIMITS: PROVIDING FOR HOURS OF DAY IN WHICH LIMITS ARE ENFORCED; PRESCRIBING A PENALTY FOR VIOLATIONS THEREOF OF A FINE OF NOT LESS THAN $25.00 OR MORE THAN $200.00; REPEALING ORDINANCES 427 AND 802; PROVIDING AN EFFECTIVE DATE; AND REPEALING ANY PORTIONS OF ORDINANCES IN CONFLICT. WHEREAS the City Council of the City of Cibolo, Texas desires to protect the safety and welfare of its citizens; and WHEREAS the City Council realizes that-a control of speed limits around and near the elementary/intermediate schools is necessary to protect the safety of school children on their way to and from school. NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: 1. A School Zone is established at the intersection of Borgfeld Road and North Main Street, extending from said intersection in a Westerly direction on Borgfeld Road to the intersection of Dietz Road and Borgfeld Road. The effective hours of the School Zone are 7:00 A.M. until 9:00 A.M. and from 2:30 P.M. until 4:00 P.M. on school days only. 2. A School Zone isestablished at the intersection of Cibolo Valley Drive and Borgfeld Road extending from said intersection in a Northerly direction on Cibolo Valley Drive to the intersection of Arnie Lane and Cibolo Valley Drive. The effective hours of the School Zone are 7:00 A.M. until 9:00 A.M. and from 2:30 P.M. until 4:00 P.M. on school days only. 3. Except as otherwise posted, the established speed for school zones is a maximum of 20 miles per hour (mph) which must be strictly observed. 4. Any violation of this ordinance shall, upon conviction, carry a fine of not less than twenty five dollars ($25.00) or more than two hundred dollars ($200.00) for each violation thereof. II. This ordinance takes precedence over Ordinances 427 and 802 which are rescinded upon passage hereof. This Ordinance shall be cumulative of all provisions of ordinances of the City of Cibolo, Texas, except where the provisions of the Ordinances are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. IV. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and section so this ordinance, since the same would have been enacted by the City Council without incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. IV. This Ordinance shall become effective immediately upon its passage, approval and publication as provided by law.
