ORD 820 11/23/2007 ORDINANCE 820 AN ORDINANCE ESTABLISHING ZONING CLASSIFICATION FOR A 2.903 ACRE TRACT OF LAND OWNED BY CHANCE BRANDT, dba JR AIR CONDITIONING TO BE RE-ZONED FROM RESIDENTIAL SINGLE FAMILY-RURAL (R-U) TO GENERAL HEAVY COMMERCIAL (C-2G). NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO, TEXAS: SECTION I. Whereas two public hearings were held to discuss such rezoning, the first being on Tuesday, October 16, 2007 at 7:00 p.m. in the Cibolo City Hall; and, the second being on Tuesday, November 13, 2007 at 7:00 p.m. in the Cibolo City Hall, for the purpose of providing all interested persons the opportunity to be heard concerning the proposed rezoning from R-U to C-2G of 2.903 acres of land by the City of Cibolo. SECTION II. And whereas the description of the 2.903 acres of land which is to be rezoned to C-2G is as follows: DESCRIPTION OF 2.903 ACRE TRACT OF LAND BEING 2.903 ACRES OUT OF 3.000 ACRES OUT OF THE GERONIMO LEAL SURVEY NO. 85, ABSTRACT NO. 210, GUADALUPE COUNTY, TEXAS, RECORDED IN VOLUME 14021,PAGE 285 OF THE DEED RECORDS OF GUADALUPE COUNTY, TEXAS. SAID 3.000 ACRE TRACT BEING MORE PARTICULARLY DESCRIBED BY METES SAID BOUNDS AS FOLLOWS: COMMENCING at a monument found for the west most corner of said 3.000 acre tract, said monument being along the south right-of-way line of FM 78; THENCE south of said right-of-way of FM 78, South 29 degrees 56 minutes 22 seconds East to the PLACE OF BEGINNING; (1) THENCE parallel to said right-of-way of FM 78, South 65 degrees 51 minutes 36 seconds East, a distance of 129.42 feet to a found monument for angle; (2) THENCE continuing parallel along the south right-of-way line of FM 78, South 65 degrees 47 minutes 13 seconds East, a distance of 25.55 feet to a found monument for corner at the north corner of the herein described tract,the north corner of a called 3.000 acre tract recorded in Volume 1202, Page 837, Official Records, Guadalupe County, Texas; (3) THENCE along the east boundary line of the called 2.903 acre tract, South 29 degrees 57 minutes 00 seconds East, a distance of 861.81 feet to a found monument for the east corner of the herein described tract,the west corner of a called 3.000 acre tract recorded in Volume 1202, Page 837, Official Records, Guadalupe County, Texas and also being on the north boundary line of a 52.2 acre tract recorded in volume 1672,page 370, Official Records, Guadalupe County; (4) THENCE along the north boundary line of the called 52.2 acre tract, South 59 degrees 59 minutes 24 seconds West, a distance of 141.56 feet to a found monument for the south corner of the herein described tract, on the north boundary line of above said 52.2 acre tract, also being the east corner of a 3.221 acre tract of land; (5) THENCE departing the north boundary line of said 52.2 acre tract, and along the northwest boundary line of said 2.903 acre tract,North 29 degrees 56 minutes 22 seconds West, a distance of 925.46 feet to the PLACE OF BEGINNING containing 2.903 acres of land, more or less.
