ORD 1056 06/25/2013 ,l O F C,& i Aft TeX AS "City of Choice" ORDINANCE NO. 10 5 6 AN ORDINANCE OF THE CITY OF CIBOLO,TEXAS,AMENDING CHAPTER 74 (TRAFFIC AND VEHICLES) OF THE CODE OF ORDINANCES BY ESTABLISHING A SPEED ZONE FOR PORTIONS OF GREEN VALLEY ROAD LOCATED WITHIN THE CITY OF CIBOLO. WHEREAS,the Texas Transportation Code Section 545.352 establishes the prima facia speed limits for streets inside and outside an urban district; and WHEREAS,the Texas Transportation Code Section 545.356 authorizes the City Council to alter the speed limits on city roadways based on the results of an engineering and traffic investigation; and WHEREAS, the Texas Transportation Code Section 545.356 provides that absent a engineering and traffic investigation the governing body of a municipality may declare a lower speed limit of not less than 25 miles per hour on a two-lane undivided highway, if the governing body determines that the prima facie speed limit on the highway is unreasonable or unsafe; and WHEREAS, Green Valley Road between Cibolo Valley Drive and the Schertz City Limits is a two-lane undivided roadway; and WHEREAS, the City Council finds that a prima facie speed greater than 25 mph is unreasonable and unsafe on this section of Green Valley Road and the City Council desires to establish the speed limit of 25 mph on this section of roadway. NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CIBOLO,TEXAS,THAT: Section 1. That the Cibolo Code of Ordinances Section 74-124 is hereby amended by adding a speed zone for Green Valley Road to as follows: Green Valley Road: 200 South Main Street,P.O.Box 826,Cibolo,Texas 78108 Phone: 210-658-9900 Fax: 210-658-1687 (4) From the Intersection of Intersection of Cibolo Valley Drive in a westerly direction to the City of Schertz city limits, a distance of approximately 0.39 Miles, 25 miles per hour Section 2. The Public Works Director and City Engineer are hereby authorized and directed to erect the appropriate signs indicating the herein enacted speed limit. Section 3. That any person found guilty of violating this ordinance will be fined not more than$200.00 for each offense. Notice of the enactment of this ordinance will be given by publishing the ordinance or its descriptive caption and penalty in the City's official newspaper one time within thirty days of passage. Section 4. This Ordinance shall be in full force and effect from and after final passage and approval of the city council of the City of Cibolo, and publication in a newspaper of general circulation PASSED AND APPROVED THIS 25th DAY OF JUNE 2013.
